CITY OF HUNTINGTON BEACH
RESOLUTION OF THE CITY COUNCIL AUTHORIZING
THE SUPERINTENDENT OF STREETS OF SAID CITY
TO ORDER CERTAIN CHANGES IN WORK AND PRO-
CEEDINGS PURSUANT TO THE "IMPROVEMENT ACT
OF 1911" WITHOUT PUBLIC HEARING.

(DUNBAR STREET SEWER AND WATER)
THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH
CALIFORNIA, HEREBY RESOLVES, FINDS, DETERMINES, DECLARES AND
ORDERS AS FOLLOWS:
SECTION 1. That the City Council of said City is pre-
sently conducting as well as contemplating certain public improve-
ments in said City under the provisions of the "Improvement Act of
1911" , being Division 7 of the Streets and Highways Code of the
State of California.
SECTION 2. Pursuant to Section 5236 of said Code, as
amended, the City Council of said City hereby authorizes the
Superintendent of Streets of said City to order certain changes,
as to be listed, in all work and proceedings instituted pursuant
to the "Improvement Act of 1911" without the necessity of a public
hearing. All orders of the Street Superintendent shall be writing
and a copy thereof to be filed with the City Clerk of said City.
The amount of any changes ordered shall not exceed One Thousand
Dollars ($1, 000. 00) when the total amount of the contract does not
exceed Twenty Thousand Dollars ($20 ,000. 00) , nor five percent (5%)
of the amount of any original contract which does exceed Twenty
Thousand Dollars ($20 ,000.00) .
SECTION 3. No change pursuant hereto shall be ordered
by said Superintendent of Streets which shall exceed Ten Thousand
Dollars ($10,000. 00) .
SECTION 4. The limitations on the cost of changes per-
mitted shall not apply where (1) the change is requested in writing
by the owner of property subject to assessment for the improvement
under construction and the nature of the change requested is such
that the cost thereof will be assessed exclusively against the pro-
perty of the person requesting the change, or (2) the change in the
work will not adversely affect the benefiting property and any
increase in the cost resulting from such changes will be paid
by the City and will not be assessed against the property within
the Assessment District .
SECTION 5 . This resolution is in no way to circumvent ,
modify, or avoid the provisions of Chapter 8 . 5 of said Streets
and Highways Code relating to public hearings and changes in
the work and proceedings .

Huntington Beach at a regular meeting_thereof held on the 21st
day of November, 1977 .

I, ALICIA M. WENTWORTH, the duly elected, qualified City
Clerk of the City of Huntington Beach, and ex-officio Clerk of the
City Council of said City, do hereby certify that the whole number of
members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 21st day
of November 19 77 by the following vote;
