HomeMy WebLinkAboutPublic Facilities Corporation - 77-17 ��PLN PUB(�C�' �� Huntington Beach Public Facilities Corporation C7 INCORPORATED m 17371 Gothard Street 2 y i NOVEMBER 27.1970 Huntington Beach, California 92647 's' awn RESOLUTION NO. 77-17 CA(IF004% A RESOLUTION OF THE BOARD OF DIRECTORS OF THE HUNTINGTON BEACH PUBLIC FACILITIES CORPORATION DIRECTING THE TRUSTEE TO REIMBURSE THE CITY OF HUN'T'INGTON BEACH FOR RENT PREVIOUSLY PAID FOR THE CIVIC CENTER COMPLEX WHEREAS the Citv of Huntington Beach has fulfilled a prior commitment to the State and Federal Governments by reimbursing the Huntington Beach Public Facilities Corporation for the full construction costs of the Emergency Operating Center within the Civic Center Complex; AND ,1HEREAS there exists surplus funds in the Bond Redemption Fund established by the Indenture or Mortgage and Deed of Trust, dated January 15, 1972 , between the Huntington Beach Public Facilities Corporation and Bank of America National Trust and Savings Association; AND WHEREAS Section 504 of the Indenture of Mortgage and Deed of Trust provides that the Trustee may consider certain balances in the Bond Red- emption Fund to be surplus and under direction may reimburse the City for rent previously paid to the Corporation; NOW, THEREFORE, the Board of Directors of the Huntington Beach Public Facilities Corporation does hereby resolve that the Trustee be requested and directed to consider $84 ,583 . 82 of the Bond Redemption Fund to be surplus and to effect reimbursement to the City of Huntington Beach for rent previously paid for the Civic Center Complex in a manner scheduled to be prorated over the term of the sublease or earlier discharge of the bonded indenture. Commencing in August of 1978 , upon receipt of an invoice from the City of Huntington Beach; the trustee shall prepare a check payable to the City of Huntington Beach in the amount of $4 , 027 . 80 each year for twenty years; and shall prepare a check for $4 ,027 . 82 in August of 1998, unless the bonded indenture be discharged prior to any of the above due dates.
