HomeMy WebLinkAboutCity Council - 4621 RESOLUTION NO. 4621 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 73-4 WHEREAS, by Resolution No. 4613, a public hearing was called for May 15, 1978 at the hour of 7: 30 p.m. , or as soon thereafter as the matter could be heard, in Council Chambers of City Hall, Huntington Beach, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles , overhead wires and associated overhead struc- tures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service on either side of the centerline of Mansion-Yorktown Avenue from five hundred (500, feet east of Main Street to the west side of Delaware Street; and Notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED That the City Council of the City of Huntington Beach hereby finds and determines that the public necessity, health, safety and welfare requires the removal of poles , overhead wires and associated structures , and the underground installation of wires and facilities for sup- plying electric , communication, or similar or associated service within that area designated as Underground Utility District No. 73-4, more particularly described as follows : That portion of Section 2, Township 6 South, JG:ahb 1. Range 11 West in the Rancho Las Bolsas , city of Huntington Beach, County of Orange, State of California, as shown on a map recorded in Book 51, page 14 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : Beginning at the centerline intersection of Main Street and Yorktown Avenue; thence north 89059145" east , 360 feet to the true point of be- ginning; thence south 0000 ' 15" east , 50 feet to a point on the south property line and the beginning of the curve of Yorktown Avenue as shown on the Precise Plan of Alignment of Yorktown Avenue 75-2; thence easterly along southerly property line of Yorktown Avenue along this described curve to its intersection with the northerly line of Tract No. 12; thence easterly along the northerly line to the easterly line of said tract , this line being the westerly line of 17th Street ; thence southerly along this westerly line of 17th Street to its intersection with the easterly line of Pine Street as shown on the Assessor's Map Book 23, page 4; thence along this line to its intersection with the easterly line of 17th Street; thence northerly along this line to its intersection with the north line of Lots 13 and 14; thence easterly along this line to its intersection with the westerly line of Lake Street ; thence southerly along this line to a point 300 feet south of the new centerline of Yorktown Avenue ; thence 90 feet at right angles to this point to its intersection with the easterly line of Lake Street; thence northerly along this line to its intersection with the southerly line of Parcel 13, Tract No. 12; thence easterly along this line to its intersection with the westerly line of the Pacific Electric Railroad right of way; thence northerly along this line to its intersection with the southerly line of Yorktown Avenue as shown on the Precise Plan of Alignment 75-2 ; thence easterly along this southerly line of Yorktown Avenue to the westerly line of Huntington Street .- thence southerly along the westerly line of Huntington Street , 300 feet south of the new centerline of Yorktown Avenue ; thence 60 feet at right angles to this point to its intersection with the easterly line of Huntington Street ; thence northerly along this line to its intersection with the south line of Parcel 19 of Block 2403, East Side Villa Tract ; thence easterly along this line to its intersection 2. with the westerly line of Tract No. 8971; thence northerly along this line to its intersection with the southerly line of Lot 1, Tract No . 8971; thence easterly along this line to its intersec- tion with the westerly line of Whitesands Drive; thence northerly to its intersection with the southerly prolongation of Lot 5, Tract No. 8971; thence easterly along this line to its intersec- tion with the easterly line of Whitesands Drive ; thence northerly along the property line of Lot 5, Tract No. 8971 to the southerly line of Yorktown Avenue; thence easterly along the southerly line of Yorktown Avenue to the westerly line of Delaware Street ; thence northerly along this line 105 feet to the northerly line of Yorktown Avenue; thence westerly along this line to its intersection with the westerly line of Parcel 24, Block 2504 of the East Side Villa Tract ; thence northerly along this line 55 feet ; thence westerly across Parcel 21, and along the northerly line of Parcels 11 and 12 of Block 2503 of the East Side Villa Tract to its intersection with the easterly line of Huntington Street ; thence northerly along the easterly line of Huntington Street to its intersection with the northerly line of 17th Street ; thence westerly along this northerly line of 17th Street as shown on Tract No. 77 to its intersection with the northerly line of Yorktown Avenue as shown on the Precise Plan of Alignment 75-2; thence westerly along the northerly line of Yorktown Avenue to its intersection with the beginning of the curve which is 360 feet easterly of the centerline of Main Street and has a bearing of north 0000 ' 15" west ; thence southerly along this line, 50 feet to the True Point of Beginning. The above described area is hereby established as Underground Utility District No. 73-4. RESOLVED FURTHER, that the City Council of the City of Huntington Beach finds that : (a) Such underground will avoid or eliminate an unusually heavy concentration of overhead distribution facilities ; and (b ) Said street right of way is extensively used by the general public and carries a heavy volume of vehicular traffic. RESOLVED FURTHER, that all poles , overhead wires and as- sociated overhead structures shall be removed and underground in- 3. stallations made in said underground utility district within the following times : (a) Underground installation by utility companies and reconnections not later than December 31, 1979 • (b) Removal of poles , overhead wires and other associated overhead structures not later than December 31, 1979 • RESOLVED FURTHER, that the City Clerk, within ten (10 ) days after the adoption of this resolution, shall mail a copy hereof and a copy of Huntington Beach Municipal Code Chapter 17. 64 to the affected utilities . Resolution No . 4220 and all resolutions in conflict here- with are hereby repealed. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5th day of Tana 1978.
