HomeMy WebLinkAboutCity Council - 4629 RESOLUTION NO. 4629 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CONFIRMING THE ASSESSMENT PUR- SUANT TO "IMPROVEMENT ACT OF 1911, " BEING DI- VISION 7 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, there has been filed with the City Clerk an assess- ment to represent the costs and expenses of the work and improve- ments done pursuant to proceedings had and taken under the provisions of the "Improvement Act of 1911, " being Division 7 of the Streets and Highways Code of the State of California, and pursuant to Resolution of Intention No. 4265, all within the boundaries of a special assessment district known and designated as ASSESSMENT DISTRICT NO. 7501 (DUNBAR STREET SEWER AND WATER) , hereinafter referred to as the "Assessment District") ; and The City Clerk has duly given notice in the manner provided by law of the filing of said assessment and of the time set for hearing; and Said City Council is now satisfied as to the proper comple- tion of the work and of the spreading of the assessment , NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Huntington Beach, California as follows : j SECTION 1. That the above recitals are all true and correct. SECTION 2. That the assessment and diagram, the proceedings leading up to the same, and all acts and determinations of the officers and agents of said city in relation to the work done and appurtenances _and_ appurtenant work in said Assessment District, and to the assessment, and the diagram attached thereto, be , and the same are hereby ratified and confirmed, the work and im- provement is accepted, and the Superintendent of Streets is hereby ordered and directed to attach to said assessment a warrant in the GH :ahb 6/22/78 1. manner and form provided by law, said warrant bearing date of this resolution, and is further ordered to deliver said war- rant, diagram and assessment to the Contractor, or its assignee , as the case may be, forthwith upon payment of the incidental expenses due thereon. SECTION 3 . That the assessment roll, warrant and diagram shall be recorded in the Office of the Superintendent of Streets and immediately thereafter the City Clerk shall file a copy of the assessment diagram in the Office of the County Recorder, and thereafter shall record in said Office of the County Recorder a Notice of Assessment, all in the manner and form as prescribed by Section 3114 of the Streets and Highways Code of the State of California.
