A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING HUNTINGTON
BEACH PUBLIC LIBRARY INFORMATION AND CULTURAL
RESOURCE CENTER TO PARTICIPATE IN CALIFORNIA
LIBRARY SERVICES ACT
WHEREAS, City of Huntington Beach maintains the Huntington
Beach Public Library Information and Cultural Resource Center
for the purposes of meeting informational, educational and
recreational needs of its residents; and
WHEREAS, the City of Huntington Beach is desirous of improv-
ing those services while deriving the greatest possible benefits
of the use of public funds by :
(a) Providing to its residents access to the materials and
services of other libraries in the state through resource sharing;
(b) Obtaining the maximum state and federal funding in
support of such sharing; and
(c) Augmenting services to those segments of the community
not presently served; and
WHEREAS, the California Library Services Board has funds
available under the California Library Services Act (Education
Code Title 1, Division 1, Part 11, Chapter 4) to assist and
support the sharing of library materials and services by Cali-
fornia' s libraries .
THEREFORE, BE IT RESOLVED that the Huntington Beach Public
Library Information and Cultural Resource Center is authorized
to participate in the programs of the California Library Services
Act ; and
BE IT FURTHER RESOLVED that the Library Director of the
Huntington Beach Public Library Information and Cultural Resource
Center be directed and authorized to annually apply for and accept
funds under this California Library Services Act , subject to
approval of the City Council.

California Library Services Act
Required Public Library participation Filings
I. Jurisdicitonal Authorization
A. Minimum information required.
1. Specific authorization from the library's jurisdiction for the
library to participate in programs of the Act.
Note: Education Code Section 18710(i) defines jurisdiction as
"a county, city and county, city, or any district which is
authorized by law to provide public library services and
which operates a public library." Thus the authoriztion
must come from the city council, the county board of super-
visors, or for library districts only, the Board of Trustees.
If a library other than a district library has a governing
board other than the city council or county board of super-
visors, the council or county board may wish to authorize
that governing board to allow or direct the library to par-
ticipate. However, according to the Act the authorization
must originate with the jurisdiction.
2. Authorization or direction for the library (either director or
board) to apply for and accept funds under the California Library
Services Act.
Note: It is our hope that this can be a one-time authorization,
f so would suggest that you be "authorized to annually apply
for and accept funds..." If your local jurisdiction re-
quires an annual authorization, obviously that .language
could not apply.
B. Kind/format of Authorization.
The jurisdictional authorization can be in the form of a resolution, minute
order, or any other legal format by which your jurisdiction provides such
authorization. The Act's only requirement is that the specific jurisdictional
authorization for participation in this Act's programs be provided.
If you have a previously executed jurisdictional authorization which
does speak to participation "... in the programs authorized by the act."
(Education Code Section 18703(a)), you may send it to the CLSA office
for review of its applicability by our legal counsel. However, since
the language of the Act is so specific on this issue, it seems unlikely
that any previously executed authorization would be okayed.
C. Sample AuthorizinS Resolution.
On the next page is a sample resolution which may be used, in whole or
in part, to obtain jurisdictional authorization. The "whereas" portions of
the resolution are strictly optional. The "Resolved" statements are
what are required. Here too, the exact language can be changed, as long
as the resolution does specifically authorize the actions outlined in A,
above.
A minute order or motion can be created out of the language of the sample
resolution.

WHEREAS, (Jurisdiction) maintains the (Library Name) for the purposes
of meeting informational, educational and recreational needs of its residents;
and
WHEREAS, the (Jurisdiction) is desirous of improving those services
while deriving the greatest possible benefits of the use of public funds by:

TARE BE IT RESOLVED that the (Library Name) is 'authorized to partici-
pate in the programs of the California Library Services Act; and
EE IT FURTHER RESOLVED that the (Director's Title) of the (Library Name)
be directed and authorized to annually apply for and accept funds under this
California Library Services Act.
