RESOLUTION NO. 4679
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 78-1
WHEREAS, by Resolution No. 4661, a public hearing was
called for September 18, 1978 at the hour of 7 : 30 p.m. , or as
soon thereafter as the matter could be heard, in Council Chambers
of City Hall, Huntington Beach, California, to ascertain whether
the public necessity, health, safety, or welfare requires the
removal of poles , overhead wires and associated overhead struc-
tures and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated
service to those properties fronting on either side of Warner
Avenue from a point three hundred (300) feet easterly of its
intersection with Greentree Lane and extending westerly to
Pacific Coast Highway, and further including those properties
fronting on each side of Marina View Place between Warner Avenue
and Los Patos Drive; and
Notice of such hearing has been given to all affected prop-
erty owners as shown on the last equalized assessment roll and
utilities concerned in the manner and for the time required by
law; and
Such hearing has been duly and regularly held, and all per-
sons interested have been given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Huntington Beach hereby finds and determines that the
public necessity, health, safety and welfare requires the removal
of poles , overhead wires and associated structures , and the under-
ground installation of wires and facilities for supplying electric,
communication, or similar or associated service within that area

designated as Underground Utility District No. 78-1, more par-
ticularly described as follows :
All the property in portions of Section 30, 29, 20,
21 and 28, Township 5 South, Range 11 West, in the
city of Huntington Beach, county of Orange , state of
California, described as follows :
Beginning at the intersection of the easterly line of
Pacific Coast Highway with the northerly line of Warner
Avenue; thence southerly along said easterly line to
its intersection with the southerly line of Warner
Avenue; thence easterly along said southerly line 3700
feet, more or less to a point 50 feet westerly of the
centerline of Marina View Place; thence 60 feet at
right angle to the northerly line of Los Patos Drive;
thence easterly along said line 220 feet more or less to
the southeast corner of Lot 1, Block L, Tract No. 475
as shown in Assessor's Map Book 110, page 2 ; thence
northerly along said easterly line 870 feet, more or
less to the northwest corner of Lot 8, Block K, Tract
No. 349 as shown in Assessor's Map Book 110, page 2;
thence easterly along the northerly line of Lot 8, 200
feet more or less to its intersection with the easterly
line of Sandra Lee Street; thence northerly along said
easterly line 150 feet, more or less to the northerly
line of Lot 11, Block J, Tract No. 349, as shown in
Assessor's Map Book 110, page 2; thence easterly along
said northerly line prolonged 270 feet, more or less to
the westerly line of Sims Street ; thence continuing
easterly along the prolongation of said line 365 feet,
more or less to the westerly line of Lot 2, Block 18,
Tract No. 86, as shown in Assessor's Map Book 110,
page 3; thence northerly along said westerly line of
Lot 2, 80 feet, more or less ; thence easterly across the
prolongation of the center of Lot 2, 1580 feet, more or
less , to its intersection with the westerly line of
Bolsa Chica Street; thence southerly along said westerly
line , 50 feet, more or less to a point; thence at right
angles , 30 feet to the centerline of Bolsa Chica Street;
thence northerly along said centerline 40 feet, more or
less to a point; thence easterly along a line parallel
with and 200 feet south, more or less , of the centerline
of Warner Avenue, 1835 feet, more or less to a point op-
posite the apparent centerline beginning of curve of El
Dorado Drive; thence northerly through the center, more
or less of Lot 153, Tract No. 5792 as shown in Assessor's
Map Book 163, page 64, also shown as Parcel 9 of Parcel
Map 7-10, records of Orange County, 305 feet, more or
less to a point ; thence westerly and parallel with

the centerline of Warner Avenue, 100 feet more or less ,
1775 feet to its intersection with the easterly line
of Bolsa Chica Street; thence northerly along said
easterly line 250 feet, more or less to a point; thence
westerly 120 feet to the westerly line of Bolsa Chica
Street; thence southerly along said line to its inter-
section with the southerly line of Parcel 9, Block 16,
Tract No. 86, as shown in Miscellaneous Maps Book 10,
pages 35 and 36, records of Orange County; thence westerly
along the prolongation of said line to its intersection
with the easterly line of Green Street; thence southerly
along said line to a point that is 90 feet north, more
or less and parallel with the centerline of Warner
Avenue; thence westerly along said line 715 feet, more
or less to the westerly line of Lynn Street; thence
northerly along said westerly line 50 feet more or less
to a point; thence westerly along the prolongation of the
northerly line of Parcel 7, Block 253, Tract No. 86, as
shown in Assessor's Map Book 178, page 25, 570 feet more
or less , to a point that is 40 feet more or less , easterly
of the easterly line of Sims Street ; thence northerly
along said line to a point 215 feet more or less north of
the centerline of Warner Avenue; thence westerly across
Sims Street 94 feet, more or less to a point on the
westerly line of said street; thence southerly along said
westerly line 110 feet, more or less , to a point on the
property line curve of Parcel 17, Block 253, Tract No.
8307; thence along the northerly line of Warner Avenue
along the curve, concave to the south, having a delta of
69034 , 4411 and a radius of 690 feet, to the end of this
curve; thence continuing westerly along said northerly
line, a tangent distance of 416. 37 feet to the beginning
of a curve, concave to the north, having a delta of
69146► 43" and a radius of 740 feet, to the end of the
curve; thence continuing westerly along said northerly
line of Warner Avenue, 2045 feet, more or less to a point
on the centerline of Weatherly Lane; thence continuing
westerly along said northerly line of Warner Avenue 1036
feet, more or less , to the True Point of Beginning.
The above described area is hereby established as Underground
Utility District No. 78-1.
RESOLVED FURTHER, that the City Council of the City of
Huntington Beach finds that :
(a) Such underground will avoid or eliminate an unusually
heavy concentration of overhead distribution facilities ; and
(b) Said street right-of-way is extensively used by the

general public and carries a heavy volume of vehicular traffic .
RESOLVED FURTHER, that all poles , overhead wires and as-
sociated overhead structures shall be removed and underground in-
stallations made in said underground utility district within the
following times :
(a) Underground installation by property owners and re-
connections not later than December 31, 1979;
(b) Removal of poles , overhead wires and other asssociated
overhead structures not later than July 1, 1980 by all utility
companies .
RESOLVED FURTHER, that the City Clerk, within ten ' (10) days
after the adoption of this resolution, shall mail a copy hereof
and a copy of Huntington Beach Municipal Code Chapter 17. 64 to
the affected property owners and utility companies .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 18th
day of September , 1978.

members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 18th day
of September 19__, by the following voter
