HomeMy WebLinkAboutCity Council - 4685 RESOLUTION NO. 4685 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING A MINIMUM EX- CISE TAX FOR HUNTINGTON BEACH MUNICIPAL CODE CHAPTER 3. 40 ENTITLED, " COMMUNITY ENRICHMENT LIBRARY FEES," TO EXEMPT COMMERCIAL AND IN- DUSTRIAL UNITS AND TO REFUND EXCISE TAX OVER- PAYMENTS WHEREAS, Section 3. 40. 030 of the Huntington Beach Municipal Code provides that the City Council, by resolution, shall establish which types of construction and the amount of an excise tax on the construction of such residential, commercial and industrial units , and mobilehome parks in the city, and that such excise tax shall not exceed $.15 per square foot of floor area, as floor area is defined in the Huntington Beach Building Code for all new con- struction; and WHEREAS, it is the desire of the City Council that said excise tax be currently set at $.05 per square foot of floor area; and WHEREAS, it is the desire of the City Council that commercial and industrial units be exempted from said excise tax; and WHEREAS, it is the further desire of the City Council that said excise tax paid in excess of $. 05, prior to the date of this resolution, be refunded to the payor, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that, pursuant to Section 3.40. 030 of the Huntington Beach Municipal Code, an excise tax upon the con- struction of each residential and mobilehome park in the city is hereby set at the rate of $. 05 per square foot of floor area, as floor area is defined in the Huntington Beach Building Code, for all classes of new construction, including any area in a building, as building is defined in the Huntington Beach Building Code, de- signed for the parking of vehicles. This resolution shall become operative on the effective date of Ordinance No. 2324 .
