HomeMy WebLinkAboutCity Council - 4686 A RESOLUTION NO. 4686 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING TRANSFER OF THE HUD PARTICIPATION IN TERRY PARK TO THE NEW PARK DEVELOPMENT CONTIGUOUS THERETO, AND REPEALING RESOLUTION NO. 4534 WHEREAS, the City of Huntington Beach in 1965 purchased a 2. 5 acre park site with assistance from the Federal Department of Housing and Urban Development ; and The city is providing a larger park adjacent to the exist- ing park; and The city desires to transfer the HUD interest in the ex- isting park site to the proposed park contiguous thereto; and The transfer of this interest is necessary to allow the existing park to be disposed of and the contemplated new park development completed, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows : SECTION 1 . The HUD interest in the existing park is hereby transferred to the proposed new park contiguous thereto, as specifically set forth in the agreement, attached hereto and in- corporated herein by reference as Exhibit 1. SECTION 2. The existing park site consists of 2. 5 acres , while the proposed park site contiguous thereto consists of five (5) acres , and based on recent appraisals the value of the new park site is approximately twice the value of the existing site. SECTION 3. Transfer of the HUD interest in the existing park site to the new site will allow the city to develop a park of adequate size and improve the quality of life for residents in the vicinity. SECTION 4 . Approval of the transfer of the HUD interest JOC:ahb 9/18/78 1 . was concurred in by writing by the Federal Department of Housing and Urban Development . SECTION 5. Resolution No. 4534 and all other resolutions in conflict herewith are hereby repealed. AGREEMENT FOR SALE AND EXCHANGE OF REAL PROPERTY THIS AGREEMENT is made and entered into this 14tb ,day of November, 1977� by and between THE CITY OF HUNTINGTON BEACH, a municipal corporation, hereinafter referred tows "CITY" and FOXX DEVELOPMENT CORPORATION, a California corpora- tion, hereinafter referred to as "FOXX" . The CITY agrees to sell FOXX the property,described herein under Exhibit "A" and FOXX agrees to convey to CITY the property described in Exhibit "B", plus the cash payment provided herein for said property upon the following terms and conditions : 1. FOXX shall page to CITY consideration in the amount of Two hundred and Four Thousand Dollars ($204,000) consisting of (a) Twenty-nine Thousand Dollars ($29,000) cash; and (b) Conveyance by FOXX to CITY the property described in Exhibit "B", situated in Orange County, State of California, said property as described in Exhibit "B" having an appraised valuation agreed upon by both parties of One Hundred and Seventy- five Thousand Dollars ($175,000) . 1978 2 . (a) On or before September 30,/ FOXX shall execute and deliver a grant deed in a form satisfactory to CITY, conveying the property described in Exhibit "B„ to CITY, and simultaneously therewith making payment of Twenty-nine Thousand Dollars ($29,000) to CITY. (b ) Within twenty (20) days thereafter, CITY shall deliver a grant deed to FOXX conveying the property described SOC.er 5/1.2/77 1, EXHIBIT 1 in Exhibit "A" . 3. Simultaneously with delivery of the grant deed to CITY, FOXX shall provide to CITY a standard California Land Title Association policy of title insurance covering the`property described in Exhibit "B"; and CITY, simultaneously with deliver- ing grant deed to FOXX, shall provide FOXX with the same type of policy of title insurance for the property described in Exhibit "A" . 4. Taxes shall be prorated to date cif recording. 5. This Agreement is subject to the CITY obtaining a release of all interest of the Federal Department of Housing and Urban See in the property described in Exhibit "A" . 6.
