HomeMy WebLinkAboutCity Council - 4753 RESOLUTION N0. 4753 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENTAL AGREEMENT WITH SOUTHERN PACIFIC TRANSPORTATION COMPANY TO EXTEND TIME FOR CONSTRUCTION OF GRADE SEPARATION WHEREAS, in 1976 Southern Pacific Transportation Company granted, and city accepted an easement over said company' s railroad right-of-way at its intersection with Ellis Avenue; and City agreed to construct , maintain and use a grade separa- tion at such intersection; and It is the desire of the parties to said agreement to ex- tend the time in which city is to perform, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that : 1. The Mayor and City Clerk are authorized to execute on behalf of city the supplemental agreement attached hereto as Exhibit A, and by this reference made a part hereof as though set out fully herein. 2. The City Clerk is hereby directed to forward certified copies of the supplemental agreement and this resolution to the Southern Pacific Transportation Company.
