A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH REQUESTING THE COUNTY OF
ORANGE TO UNDERTAKE THE DEFENSE OF THE CITY
IN THE MATTER OF SECURITY PACIFIC NATIONAL
BANK V. COUNTY OF ORANGE, ET AL.
WHEREAS, Security Pacific National Bank has brought suit
against the County of Orange, the City of Huntington Beach,
and other cities in the county for property taxes collected
by the county on behalf of such cities, which taxes were paid
under protest; and
Section 5138 of the California Revenue and Taxation Code
provides that when such a suit is filed, a city may call upon
the county to undertake the defense of the action,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Huntington Beach hereby requests the County of
Orange to undertake the defense of the City of Huntington Beach
in the matter of Security Pacific National Bank v. County of
Orange, et al . , Orange County Superior Court Case No . 31-38-25.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 2nd
day of July 1979.

that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 2nd day
