HomeMy WebLinkAboutCity Council - 4773 RESOLUTION NO. 4773 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF THE STREET RIGHT-OF-WAY ADJACENT TO CENTER DRIVE WHEREAS, on June 18, 1979 , the City Council of the City of Huntington Beach duly adopted Resolution No. 4764 de- claring its intention to vacate the street right-of-way adja- cent to Center drive , and referring to maps or plans on file in the office of the City Clerk for particulars as to the pro- posed vacation; and Said resolution fixed the time and place of July 16, 1979 at the hour of 7: 30 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the pro- posed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along the street right-of- way adjacent to Center Drive, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On July 16, 1979 , at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of the street right-of-way adjacent to Center Drive, at which time no objection was made to said vacation, and evidence was presented showing that such street right-of-way is not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington /ahb 1. 7/6/79 Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320, does resolve that the street right-of-way adjacent to Center Drive is not necessary for present or prospective public street purposes, and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the street right-of-way adjacent to Center Drive be and the same is hereby vacated; and said street right-of- way so vacated is more particularly described as follows : That portion of the southeast quarter of the southeast quarter of Section 14, Township 5 South, Range 11 West in the Rancho Las Bolsas and Rancho La Bolsa Chica, city of Huntington Beach, County of Orange, State of California as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows: Beginning at the southeast corner as per map re- corded in Book 81, page 12 of parcel maps in the office of the County Recorder of said county, said southeast corner also being the intersection of San Diego Freeway Route 405 and the north line of the Southern California Edison right-of-way; thence south 39032103" west 392. 45 feet along the south boundary line of said Parcel Map 81-12, said boundary line also being the north right-of-way line of the Southern California Edison right-of-way; thence north 0127' 57" west 70.00 feet to the True Point of Beginning, said point being a point of cusp with north right-of-way line of Center Drive as shown on said Parcel Map 81-12, and a curve concave to the southwest having a radius of 590. 00 feet ; a radial line to said point bears north 0127' 57" west; thence southeasterly along said curve through a central angle of 20002' 5811 , an arc distance of 206.46 feet to a point on a nontangent curve concave to the southwest having a radius of 56. 00 feet , said curve being the right-of- way line of Center Drive as shown on said Parcel Map 81-12; thence northwesterly along said curve through a central angle of 6804812611 an arc distance of 67.25 feet to the north right-of-way line of Center Drive; thence south 89032103" west 150.06 feet along said north right-of-way line to the True Point of Beginning. 2 PASSED AND ADOPTED by the City council of the City of Huntington Beach at a regular meeting thereof held on the 16th day of July , 197 9 Mayor Pro Temfore ATTEST: APPROVED AS TO FORM: ALICIA M.
