RESOLUTION NO. 4795 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF THE STREET RIGHT-OF-WAY ADJACENT TO SEVENTEENTH STREET WHEREAS, on August 6, 1979 the City Council of the City of Huntington Beach duly adopted Resolution No. 4786 declaring its intention to vacate the street right-of-way adjacent to Seventeenth Street , and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of September 4, 1979 at the hour of 7: 30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less .than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along the street right-of-way adjacent to Seventeenth Street , and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On September 4, 1979 at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of the street right-of-way adjacent to Seventeenth Street, at which time no objection was made to said vacation, and evidence was presented showing that such street right-of-way is not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 2 of the California /ahb 8/28/79 1. Streets and Highways Code, commencing with Section 8320, does resolve that the street right-of-way adjacent to Seventeenth Street is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the street right-of-way adjacent to Seventeenth Drive be and the same is hereby vacated; and said street right- of-way so vacated is more particularly described as follows: That portion of 17th Street in the city of Huntington Beach, County of Orange, State of California as shown on a map of Tract No. 77 , recorded in Book 10 , page 20 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows: Beginning at the intersection of the centerline of 17th Street and the east right-of-way line of the Southern Pacific Railway Company as shown on said map of Tract No. 77; thence north 89°57123" east 81.98 feet; to the beginning of a tangent curve concave to the northwest having a radius of 90 .00 feet; thence along said curve through a central angle of 43018 ' 37" an arc length of 68.03 feet to a point to which a radial bears south 43121 '14" east last said point being also a point on a nontangent curve concave to the northwest having a radius of 850 .00 feet , a radial line to said point from said 850 .00 foot radius point bears south 70461281, east; thence northeasterly along said curve through a central angle of 3038 '24" an are distance of 54.04 feet; thence south 39112 '53" west 28.86 feet to a point on a curve concave to the northwest having a radius of 125 .00 feet; thence southwesterly along said curve through a central angle of 40044 ' 30" an are distance of 110 .70 feet; thence south 84 °57'23" west 82.00 feet to said east right-of-way line of said railway company; thence north 0000' 52" west 35.00 feet to the point of beginning.
