A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING TUITION REIMBURSE-
MENT PLAN FOR POLICE OFFICERS HIRED AFTER
JULY 11 1979
WHEREAS , the City of Huntington Beach and the Huntington
Beach Police Officers Association are parties to a Memorandum
of Agreement, approved by the City Council on April 2. 1979, to
remain in effect to and including September 30 , 1980; and
During the negotiations which culminated in the aforesaid
Memorandum of Agreement , the parties reached impasse as to a
number of issues , including the question of whether or not sworn
personnel hired after July 1 , 1979 would be eligible under the
educational incentive plan for sworn personnel; and
Pursuant to Section 9 of Resolution No . 3335, as amended,
said impasse was submitted to advisory fact finding, and on
February 16 , 1979 said fact finder recommended the adoption of
the city' s proposal that a tuition reimbursement plan be pro-
vided for employees hired after July 1 , 1979 in lieu of the
educational incentive plan; and
In paragraph 1 of Article IX of said Memorandum of Agreement,
the parties reserved their respective positions regarding the
question of eligibility under said educational incentive plan
for employees hired after July 1, 1979 and agreed to meet during
the month of September 1979 for the purpose of reviewing their
respective positions and such other alternatives as the parties
deemed appropriate; and
Representatives of the city and the Huntington Beach
Police Officers Association have met on several occasions and
conferred in good faith and have pursued various alternatives
to their respective positions but failed to reach agreement on

any of the alternatives discussed; and
Pursuant to said paragraph 1 of Article IX of said
Memorandum of Agreement , the City Council desires to implement
its proposal as aforesaid and as recommended by said fact
finder,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach as follows:
1 . Sworn personnel hired after July 1 , 1979 in the police
department shall be eligible for reimbursement for tuition and
books for attending courses approved by the department head.
Such reimbursement shall be at the level for the state university
system and shall be subject to all of the conditions and regula-
tions set forth in Article IX of the Memorandum of Agreement be-
tween the City of Huntington Beach and the Huntington Beach
Police Officers Association, dated March 19 , 1979.
. 2 . Sworn personnel hired after July 1 , 1979 in the police
department shall not be eligible for the educational incentive
plan set forth in Article IX of said Memorandum of Agreement.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 19th
day of November 1979.

that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 19th day
of November 1979 by the following vote:
