A RESOLUTION OF THE CITY COUNCIL OF THE CITY
HUNTINGTON BEACH ADOPTING REGULATIONS FOR
CANDIDATES FOR ELECTIVE OFFICE , PERTAINING TO
MATERIALS SUBMITTED TO THE ELECTORATE AND THE
COSTS THEREOF FOR THE GENERAL MUNICIPAL ELEC-
TION TO BE HELD IN SAID CITY ON TUESDAY,
APRIL 8, 1980
WHEREAS , section 10012 of the California Elections Code
provides that the governing body of any local agency adopt regu-
lations pertaining to materials prepared by any candidate for a
municipal election, including costs thereof,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve, declare, determine and order as
follows:
SECTION 1. GENERAL PROVISIONS . That pursuant to section 10012
of the California Elections Code, each candidate for elective office
to be voted for at the general municipal election to be held in
the city of Huntington Beach on April 8, 1980, may prepare a
candidate' s statement on an appropriate form provided by the City
Clerk. Such statement may include the name, age and occupation of
the candidate and a brief description of no more than two hundred
( 200) words of the candidate 's education and qualifications , ex-
pressed by the candidate himself. Such statement shall not in-
clude party affiliation of the candidate, membership or activity
in partisan political organizations . Such statement shall be filed
in the office of the City Clerk at the time the candidate' s nomi-
nation papers are filed . Such statement may be withdrawn, but not
changed, during the period for filing nomination papers and until
5 p .m. of the next working day after the close of the nomination
period.
SECTION 2. That in compliance with the recent amendments to

12/5/79 1 .
the Federal Voting Rights Act of 1965 (Public Law 94-73 , August 6 ,
1975) , the City Clerk shall provide a Spanish translation of the
candidate' s statement which shall be available to anyone requesting
the translation.
SECTION 3. ADDITIONAL MATERIALS . No candidate will be per-
mitted to include additional materials in the sample ballot pack-
age .
SECTION 4. PAYMENT. The City Clerk shall estimate the total
cost of printing, handling, translating, and mailing the candidate' s
statements , filed pursuant to the Elections Code, and require each
candidate filing a statement to pay in advance his or her pro rata
share as a condition of having his or her statement included in
the voter' s pamphlet. The City Clerk shall bill each candidate for
any cost in excess of the deposit and shall refund any unused
portion of any deposit.
SECTION 5. That the City Clerk shall provide each candidate
or the candidate ' s representative a copy of this resolution at the
time nominating petitions are issued .
SECTION 6. That the City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the book
of original resolutions of said city; and shall make a minute of
passage and adoption thereof in the records of the proceedings of
the City Council of said city in the minutes of the meeting at which
the same is passed and adopted.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 17th
day of December, 1979 •

I, ALICIA M. WENTWORTH, the duly elected, qualified City
Clerk of the City of Huntington Beach, and ex-officio Clerk of the
City Council of said City, do hereby certify that the whole number of
members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 17th day
of December 19 79 by the following vote:
