HomeMy WebLinkAboutCity Council - 4818 RESOLUTION NO . 4818 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENT NO . 06 TO AGREEMENT NO. 07-5181 TO IMPROVE THE SOUTHERN PACIFIC TRANSPORTATION COMPANY 'S RAILROAD CROSSING NO. BAA 521.59 ON TALBERT AVENUE WHEREAS , on February 7, 1978 the city entered into an agree- ment with the State of California for the Federal-Aid Program, identified as Agreement No . 07-5181 ; and Program Supplement No . 06 to the above-mentioned master agreement requires the replacement of existing crossbucks with flashing lights at the Southern Pacific Transportation Company' s railroad crossing (No . BAA 521 .59) on Talbert Avenue in this city; and The total cost of such public safety improvement program is $71 ,000 which amount will bq appropriated from Federal and state funds , as shown on Exhibit attached, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that the Mayor and City Clerk are au- thorized and directed to execute the necessary documents to imple- ment Program Supplement No . 06 to Master Agreement No. 07-5181 for the purpose of improving Southern Pacific Transportation Company' s railroad crossing at Talbert Avenue. December 14, 1979 Program Supplement No. 6 (Revised) Local Agency CitX of Huntington Beach SPECIAL COVENANT for use of item 169.1 Funds to match Railroad Protection (RRO, RRP) Funds. Funds required to match Federal Highway Funds in the projec will be provided by the State as authorized by Item 169.1 of the Budget Act of 1979 and allocated by the California Transportation Oommission. In the event item 169.1 funds less than the amount shown ar required, the excess will be returned to the Statewide reserve. In the event item 169.1 funds greater than the amount shown ire required, the required amount may be added subject to the availability of funds and provided said addition of funds can be made priorto the execution of the Federal-State Project Agreement. Item 169.1 funds will not be available for increased project costs following the execution of the Federal-State Project Agreement. After completion of the final cost accounting for a project, any unexpended item 169.1 funds will revert to the Statewide reserve. As required by California Transportation Commission Resolution for all recipients of 169.1 funds, the Local Agency shall report to the Commission prior to July 1,- 1980 the uses made of the 169.1 funds, how the recipient conformed with the uses permitted by the resolution, and how the local agency matching funds that were released were used. The attached Special Covenant explains the State Matching 169.1 Fund use . 3 . All required signing and marking at RR Xing will be completed in accordance with the requirement of MUTCD, 1978. 4. In agreeing to the construction of this project, the Local Agency agrees the payment of Federal funds will be limited to the detail estimate amount approved by the Federal High- way Administration in the Federal-Aid Project Agreement (PR-2) , or its modification (PR-2A) , and accepts any increases in Local Agency contribution. 5.
