HomeMy WebLinkAboutCity Council - 4844 RES OLUTI ON NO . 4844 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF FORMER TALBERT DRAINAGE DISTRICT EASEMENT LO- CATED SOUTH OF ATLANTA AVENUE AND WEST OF BEACH BOULEVARD WHEREAS , on January 7 , 1980 the City Council of the City of Huntington Beach duly adopted Resolution No . 4823 declaring its intention to vacate former Talbert Drainage District ease- ment located south of Atlanta Avenue and west of Beach Boulevard, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of February 4, 1980 at the hour of 7: 30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen ( 15 ) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along former Talbert Drainage District easement across Tract 9580, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On February 4, 1980 at the hour of 7: 30 p .m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of former Talbert Drainage District easement across Tract 9580, lo— cated south of Atlanta Avenue and west of Beach Boulevard, at which time no objection was made to said vacation, and evidence was presented showing that the vacation of former Talbert Drainage District easement across Tract 9580 is not necessary for present /ahb 1/21/80 1 . and prospective public street purposes and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9 , Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320, does resolve that former Talbert Drainage District easement across Tract 95803, located south of Atlanta Avenue and west of Beach Boulevard, is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that former Talbert Drainage District easement across Tract 9580, located south of Atlanta Avenue and west of Beach Boulevard, be and the same is hereby vacated; and said former Talbert Drainage District easement so vacated is more particularly described as follows: All that certain strip of land, 20.00 feet in width, conveyed to the Talbert Drainage District by deed, recorded October 13, 1950 in Book 2087, page 393 of official records of Orange County, California, lying within the following described land: Tract No . 9580 , as shown on a map recorded in Book 444 , pages 29 through 31 inclusive of Miscellaneous Maps in the office of the County Recorder of said Orange County, the boundaries of which are more particularly described as follows: Beginning at the northeast corner of said Tract No . 9580, said corner lying distant south 89 °43 '00" west 155.00 feet from the northeast corner of Section 14, Township 6 South, Range 11 West, S .B.B.&M. ; thence along the easterly boundary of said tract the following courses: south 00°17 ' 00" east 30.00 feet, north 89043100" east 105 .24 feet and south 00044122" west 1290.00 feet to the southeast corner of said tract; thence along the southerly, westerly and northerly boundary of said tract the following courses: south 8904310011 west 1275.54 feet, north 00043' 14" west i 2. 1320.00 feet and north 89°43100" east 1170.10 feet to the point of beginning. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 4th day of February, 1980 .
