HomeMy WebLinkAboutCity Council - 4846 RESOLUTION NO.4846 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING EXECUTION OF AGREEMENT FOR INSTALLATION OF TRAFFIC SIGNAL AT THE INTERSECTION OF GOLDENWEST STREET AND PALM AVENUE WHEREAS, the City of Huntington Beach imposed as one of the final conditions of approval for Tentative Tract Maps 10067, 10068 and 10069 for Seacliff Phase IV project , the installation of a traffic signal at Goldenwest Street and Palm Avenue . NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows : 1. The attached agreement with the Huntington Beach Company is hereby approved, and 2. The Mayor of the City of Huntington Beach is hereby authorized to execute the attached agreement on behalf of the city. Mayor ATTEST: APPROVED AS TO FORM: z4 City Clerk -City' Attorney REVIEWED AND APPROVED: 'MATEY AND PROVED: Cit Administrator Director of Public Works JG:bc 1 . 12/13/79 TRAFFIC SIGNAL AGREEMENT THIS AGREEMENT, made and entered into this ,,?D day of 1979 , by and between the Huntington Beach (,omp� ny, a California corporation , hereinafter called "COMPANY" and the City g of Huntington Beach a municipal corporation of P p the State of California , hereinafter called "CITY" W IT NES SETH: WHEREAS , the intersection of Goldenwest Street and Palm Avenue lie within CITY, and Engineering studies indicate that installation of a traffic a,l is warranted at the above named intersection for improved traffic safety and efficiency, and One of the final conditions of approval for Tentative Tract Maps 10067 , 10068 and 10069 for Seacliff Phase IV project, is the installation of a traffic signal at the above named intersection. The costs of such installation shall he evenly divided by COMPANY and CITY. NOW, THEREFORE, in consideration of the covenants and con- ditions herein contained, the parties hereto agree as follows : 1 . CITY shall prepare plans and specifications , provide engineering and contract administration, for the installation of a traffic system at the intersection of Goldenwest Street and Palm Avenue . 1 . JG: be 12/12/79 2 . CITY shall advertise for bids, pursuant to California ; t-,ate law.`- 3. CITY'S Department of Public Works shall supervise the performance of said work. It . The cost of the installation of the traffic signal system Is estimated to be approximately sixty-five thousand dollars ($65,000) . The COMPANY shall pay fifty percent (50%) of the actual gusts but, not to exceed thirty-five thousand dollars ($35,000) . The CITY shall pay fifty percent (50%) of the actual costs and all costs beyond COMPANY'S thirty-five thousand dollars ($35,000) max_lmuni contribution. 5. COMPANY shall pay its proportionate share forthwith upon 1,11e issuance of a building permit for the Seacliff Phase IV project . 6. CITY shall require the contractor who receives the bid to keep an exact accounting of the expenditures on the traffic signal. project, T . Upon completion of the installation of the traffic signal system at the intersection of Goldenwest Street and Palm Avenue, the maintenance of said system shall be performed by or under the direction of CITY. The cost of said maintenance shall be borne by CITY. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and year first above written.
