HomeMy WebLinkAboutCity Council - 4864 RESOLUTION NO . 4 864 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THAT THE PUBLIC IN- TEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR THE CONSTRUCTION OF A FIRE STATION, AUTHORIZING THE CONDEMNATION OF SAID PROPERTY OR NEGOTIATION FOR ACQUISITION, AND DIRECTING ITS ATTORNEY TO PROCEED WITH SUCH ACTION WHEREAS , the City of Huntington Beach desires to construct a new fire station, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it finds , determines and declares as follows: 1 . The public interest and necessity require the acquisi- tion, annexation and construction of a new fire station facility. 2 . The real property or interest in real property, de- scribed herein and graphically depicted in Exhibit A attached hereto and incorporated herein by this reference , is necessary for said proposed public improvement . 3 • The use for which said property is being acquired is a public use authorized by law, to wit: construction of a fire station. 4 . It is necessary that the taking of said property or in- terest in real property be in fee simple. 5 • The City Attorney for the City of Huntington Beach is hereby authorized, directed and empowered to acquire in the name of the City of Huntington Beach, a municipal corporation, a fee simple estate in and to said hereinafter described real property or interest in real property, by condemnation in accordance with the provisions of the Code of Civil Procedure sections 1237 et seq. and the Constitution of the State of California relating to eminent domain, and such other statutes of the State of California /ahb 3/3/80 1. as may be applicable, and to commence such proceeding or pro- ceedings as are necessary for such acquisition in the proper court having jurisdiction thereof. 6 . The real property or interest in real property which the City of Huntington Beach is by this resolution authorized to ac- quire is situated in the city of Huntington Beach, County of Orange, State of California and is more particularly described as follows: PARCEL A: That portion of Block 503 , Main Street Section of Huntington Beach in the city of Huntington Beach, County of Orange, State of California, as per map recorded in Book 3 , page 43 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows: Beginning at the northeasterly corner of said lot; thence south 123 .43 feet along the easterly line of said lot to the northeasterly corner of the land described in the deed to the City of Huntington Beach, recorded June 22, 1939 in Book 996, page 422 of Official Records; thence south 72/09110/1 west 138 .78 feet along the northwesterly line of said land to the northwesterly corner thereof being a point in the westerly line of said lot; thence north 155 .63 along said westerly line to the northwesterly corner of said lot; thence east 132.10 feet along the northerly line of said lot to the point of beginning. EXCEPT THEREFROM the northerly 100.00 feet. PARCEL B: The north 100 feet of Block 503 of Huntington Beach, Main Street Section in the city of Huntington Beach, County of Orange, State of California as per map thereof recorded in Book 3 , page 43 of Miscellaneous Maps in the office of the County Recorder of said county.
