HomeMy WebLinkAboutCity Council - 4870 RESOLUTION NO . 4870 A RESOLUTION OF THE CITY COUNCIL OF THE CITY HUNTINGTON BEACH REQUESTING THE COUNTY OF ORANGE TO UNDERTAKE THE DEFENSE OF THE CITY IN THE MATTER OF SOUTHERN PACIFIC TRANSPORTA- TION COMPANY, ET AL. V. BOARD OF EQUALIZATION OF THE STATE OF CALIFORNIA, ET AL. WHEREAS , Southern Pacific Transportation Company, together with other railroads, has brought suit against the state Board of Equalization, the County of Orange, the City of Huntington Beach and other cities and counties in the state for property taxes collected by such counties on behalf of such cities; and Section 5138 of the California Revenue and Taxation Code provides that when such a suit is filed, a city may call upon the county to undertake the defense of the action, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby requests the County of Orange to undertake the defense of the City of Huntington Beach in the matter of Southern Pacific Transportation Company, et al . v. Board of Equalization of the State of California , et al . , Sacramento County Superior Court Case No. 282416. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5th day of May 1 g 80.
