A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH OF INTENTION TO VACATE
EXCESS STREET RIGHT-OF-WAY ON WEST SIDE OF
NEWLAND STREET, NORTH OF YORKTOWN AVENUE
The City Council of the City of Huntington Beach does
hereby resolve as follows:
SECTION 1. A public meeting was held before the Planning
Commission on July 17 , 1979 at which time it was determined,
pursuant to Government Code Section 65402 , that the proposed va-
cation of the excess street right-of-way on the west side of
Newland Street, north of Yorktown Avenue, conformed to the
city' s general plan.
SECTION 2. Pursuant to Division 9 , Part 3, Chapter 2 of
the California Streets and Highways Code (Sections 8320 et seq. ) ,
the City Council of the City of Huntington Beach hereby declares
its intention to vacate the excess street right-of-way on the
west side of Newland Street, north of Yorktown Avenue , more
particularly described as follows:
That portion of Section 1, Township 6 South,
Range 11 West , in the Rancho Las Bolsas , city of
Huntington Beach, County of Orange, State of
California, as shown on a map recorded in Book 51,
page 14 of Miscellaneous Maps in the office of the
County Recorder of said county described as follows :
Beginning at the intersection of the center-
line of Bridgeport Drive and the east boundary line
of Tract No . 3908 , said east boundary line also
being the centerline of Newland Street as shown on
a map recorded in Book 138 , page 17 of Miscellaneous
Maps in the office of the Recorder of said county;
thence south 8905814011 west 55 .00 feet along the
centerline of said Bridgeport Drive; thence south
000112011 east 39 .75 feet to a point on a curve con-
cave to the southwest having a radius of 28 .00 feet ,

said point being the true point of beginning, a
radial to said point bears north 37021140 " east;
thence along said curve southeasterly and southerly
through a central angle of 52037 ' 00" an arc distance
of 25. 71 feet; thence north 89058140 " east 4.00 feet
to a point on a line parallel with and 40 .00 feet
west measured at right angles from the centerline
of said Newland Street; thence along said parallel
line south 0001120" east 1022.00 feet to a curve
concave westerly having a radius of 32 .00 feet;
thence southerly along said curve through a central
angle of 15054108" an arc distance of 8 .88 feet;
thence north 7400711211 west along the radial from
said point 3.00 feet to a point on a concentric curve
concave to the northwest having a radius of 29 .00
feet; thence southwesterly along said curve through
a central angle of 57043 ' 54" an are distance of
29.22 feet; thence south 16023 ' 18" east along the
radial line to said point 3.00 feet to a point on a
concentric curve concave northerly, having a radius
of 32.00 feet; thence westerly along said curve
through a central angle of 15054108" an arc distance
of 8.88 feet to a point on a line parallel with and
40 .00 feet north measured at right angles from the
centerline of Yorktown Avenue as shown on said map
of Tract 3908; thence north 89°33 '30" west along said
parallel line 2.73 feet; thence north 45012 ' 35" east
28.17 feet to a point on a line parallel with and
55.00 feet west measured at right angles from said
centerline of Newland Street; thence north 0001120"
west 1056.39 feet along said parallel line to the
true point of beginning.
The city hereby reserves and excepts from the vacation a
permanent easement and right at any time or from time to time,
to construct, maintain, operate , replace, remove and renew
storm drains and appurtenant structures in, upon, over and
across such street or any portion thereof proposed to be va-
cated and pursuant to any existing franchises or renewals thereof ,
or otherwise to construct, maintain, operate, replace , remove,
renew and enlarge lines of pipe , conduits , cables , wires , poles ,
and other convenient structures , equipment and fixtures for the
operation of gas pipelines , telegraphic and telephone lines,
railroad lines , and for the transportation or distribution of
electric energy, petroleum and its products , ammonia, water, and

incidental purposes, including access and the right to keep the
property free from inflammable materials , and wood growth, and
otherwise protect the same from all hazards in, upon and over
said west side of Newland Street or part thereof proposed to be
vacated.
SECTION 3. The City Clerk is directed to maintain on file
in the office of the City Clerk maps or plans showing the par-
ticulars of the proposed vacation of the excess street right-of-
way on the west side of Newland Street, north of Yorktown Avenue,
and reference is hereby made to said maps or plans for said par-
ticulars as to said proposed vacation.
SECTION 4 . The City Council does hereby fix July 8 , 1980
at the hour of 7: 30 p .m. , or as soon thereafter as the matter
may be heard in Council Chambers in the Civic Center, as the time
and place for hearing all persons interested in or objecting to
the proposed vacation, which time is not less than fifteen (15)
days from the passage of this resolution.
SECTION 5 . The City Clerk is directed to cause a copy of
this resolution to be published in the Huntington Beach
Independent, a newspaper of general circulation within fifteen
( 15 ) days of the passage of this resolution.
SECTION 6. The Street Superintendent is directed to post,
or cause to be posted, notices of vacation conspicuously along
the excess street right-of-way on the west side of Newland Street,
north of Yorktown Avenue, proposed to be vacated at least ten ( 10)
days before the date of the hearing. Such notices shall be
posted not more than three hundred (300) feet apart, but at
least three ( 3) shall be posted. Such notices shall state the
passage of this resolution of intention and the time and place
of hearing.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 2nd
day of June 1980.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

The City Council of the City of Huntington each does
hereby resolve as follows:

being the centerline of Newland Street as shown on
a map recorded in Book 138, page 17 of Miscellaneous
