HomeMy WebLinkAboutCity Council - 4898 RESOLUTION NO . 4898 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF AN EASEMENT FOR WATERLINE PURPOSES IN TRACT NO. 9580 WHEREAS , on June 2 , 1980 the City Council of the City of Huntington Beach duly adopted Resolution No . 4877 declaring its intention to vacate an easement for waterline purposes in Tract 9580, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of July 8 . 1980 at the hour of 7: 30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the pro- posed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along the easement for water- line purposes proposed to be vacated, and such notices were posted not more than three hundred ( 300) feet apart and at least three (3) were posted. At an adjourned regular meeting on July 8, 1980 at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of an easement for waterline purposes in Tract 9580, at which time no objection was made to said vacation, and evidence was presented showing that such waterline easement is not necessary for present and prospective public street pur- poses and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington /ahb 6/23/80 1 . REVIEWED AND APPROVED: INITIATED AND APPROVED: 01 Citk Administrator Director of Public Works 3. Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Sec- tion 8320, does resolve that the easement for waterline pur- poses in Tract 9580 is not necessary for present or prospective public street purposes , and is not suitable for use or develop- ment as bicycle paths or routes , and it is hereby ORDERED that the easement for waterline purposes in Tract 9580 be and the same is hereby vacated; and said water- line easement so vacated is more particularly described as follows: That portion of Lot 10 of Tract No. 9580 in the city of Huntington Beach, County of Orange , State of California as shown on a map recorded in Book 444, pages 29 to 31 inclusive of Miscellaneous Maps in the office of the County Recorder of said county, de- scribed as follows: An easement for waterline purposes, as dedicated to the City of Huntington Beach over that certain strip of land shown on said map as "Neptune Drive , Private Street. " Excepting therefrom the easterly 15.5 feet of said Lot 10, included within "Poolside Lane - Private Street" and the easterly 18.5 feet of "Sundown Lane , Private Street, " all as shown on said map. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at an adjourned regular meeting thereof held on the 8th day of July, 1980.
