A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
EXCESS STREET RIGHT-OF-WAY ON WEST SIDE OF
NEWLAND STREET, NORTH OF YORKTOWN AVENUE
WHEREAS , on June 2 , 1980 the City Council of the City of
Huntington Beach duly adopted Resolution No . 4878 declaring
its intention to vacate the excess street right-of-way on the
west side of Newland Street, north of Yorktown Avenue ,
and referring to maps or plans on file in the office of the
City Clerk for particulars as to the proposed vacation; and
Said resolution fixed the time and place of July 7, 1980
at the hour of 7: 30 p .m. , or as soon thereafter as the matter
could be heard, in the Council Chambers in the Civic Center,
for hearing all persons interested in or objecting to the pro-
posed vacation, which time was not less than fifteen (15 ) days
from the passage of said ras..olution. Notices of the proposed
vacation were posted conspicuously along the excess street
right-of-way on the west side of Newland Street, north of
Yorktown Avenue, and such notices were posted not more than
three hundred (300) feet apart and at least three ( 3) were posted.
At an adjourned regular meeting on July 8 , 1980 at the hour
of 7: 30 p.m. , in the Council Chambers in the Civic Center, the
City Council of the City of Huntington Beach did convene for the
purpose of hearing all persons interested in or objecting to the
proposed vacation of the excess street right-of-way on the west
side of Newland Street, north of Yorktown Avenue , at which time
no objection was made to said vacation, and evidence was pre-
sented showing that the excess street right-of-way on the west
side of Newland Street, north of Yorktown Avenue , is not nec-
essary for present and prospective public street purposes and is

not suitable for use or development as bicycle paths or routes.
NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9 , Part 3, Chapter 2 of the California
Streets and Highways Code, commencing with Section 8320, does
resolve that the excess street right-of-way on the west side of
Newland Street, north of Yorktown Avenue, is not necessary for
present or prospective public street purposes , and is not suit-
able for use or development as bicycle paths or routes , and it
is hereby
ORDERED that the excess street right-of-way on the west side
of Newland Street, north of Yorktown Avenue , be and the same is
hereby vacated; and said excess street right-of-way so vacated
is more particularly described as follows:
That portion of Section 1, Township 6 South,
Range 11 West , in the Rancho Las Bolsas, city of
Huntington Beach, County of Orange, State of
California, as shown on a map recorded in Book 51,
page 14 of Miscellaneous Maps in the office of the
County Recorder of said county described as follows:
Beginning at the intersection of the center-
line of Bridgeport Drive and the east boundary line
of Tract No . 3908 , said east boundary line also
being the centerline of Newland Street as shown on
a map recorded in Book 138 , page 17 of Miscellaneous
Maps in the office of the Recorder of said county;
thence south 8905814011 west 55 .00 feet along the
centerline of said Bridgeport Drive; thence south
0001120/1 east 39 .75 feet to a point on a curve con-
cave to the southwest having a radius of 28 .00 feet ,
said point being the true point of beginning, a
radial to said point bears north 3712114011 east;
thence along said curve southeasterly and southerly
through a central angle of 52°37100" an arc distance
of 25.71 feet; thence north 89058140/1 east 4.00 feet
to a point on a line parallel with and 40 .00 feet
west measured at right angles from the centerline
of said Newland Street; thence along said parallel
line south 0/0112011 east 1022.00 feet to a curve
concave westerly having a radius of 32 .00 feet;
thence southerly along said curve through a central
angle of 15054108/1 an arc distance of 8.88 feet;

concave to the northwest having a radius of 29 .00
feet; thence southwesterly along said curve through
a central angle of 57043 ' 54" an arc distance of

concentric curve concave northerly, having a radius
of 32.00 feet; thence westerly along said curve
through a central angle of 15054108" an arc distance
of 8.88 feet to a point on a line parallel with and
40 .00 feet north measured at right angles from the
centerline of Yorktown Avenue as shown on said map
of Tract 3908 ; thence north 89033 ' 30" west along said

28.17 feet to a point on a line parallel with and
55.00 feet west measured at right angles from said
centerline of Newland Street; thence north 0001120"
west 1056.39 feet along said parallel line to the
true point of beginning.
The city hereby reserves and excepts from the vacation a
permanent easement and right at any time or from time to time,
to construct, maintain, operate , replace, remove and renew
storm drains and appurtenant structures in, upon, over and
across such street or any portion thereof ordered to be vacated
and pursuant to any existing franchises or renewals thereof, or
otherwise to construct, maintain, operate, replace, remove, re-
new and enlarge lines of pipe, conduits, cables , wires , poles ,
and other convenient structures , equipment and fixtures for the
operation of gas pipelines , telegraphic and telephone lines ,
railroad lines, and for the transportation or distribution of
electric energy, petroleum and its products , ammonia, water,
and incidental purposes , including access and the right to keep
the property free from inflammable materials , and wood growth,
and otherwise protect the same from all hazards in, upon and
over such street or part thereof proposed to be vacated.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at an adjourned regular meeting thereof held
