HomeMy WebLinkAboutCity Council - 4917 RESOLUTION NO- 4917 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING CERTAIN REAL PROPERTY SURPLUS AND INTENT TO SELL SUCH SUR- PLUS PROPERTY LOCATED BETWEEN TALBERT AVENUE AND TAYLOR DRIVE WEST OF BEACH BOULEVARD WHEREAS, in 1978 the City of Huntington Beach completed the purchase of a 15-acre surplus school site from the Ocean View School District; and WHEREAS, the city has fulfilled its obligation to the residents of the neighborhood by constructing a five-acre park with a community building on the southern portion of the acreage. NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve as follows : SECTION 1. Pursuant to Division 3, Chapter 5, Article 1 of the California Government Code (Sections 37350 et seq. ) , the City Council of the City of Huntington Beach finds and declares that certain city-owned real property, specifically that 10-acre segment on the north and adjacent boundary of Victor Terry Park, between Talbert Avenue and Taylor Drive west of Beach Boulevard, is surplus property and hereby declares its intentions to sell such city-owned property, more particularly described as follows : Parcel 1 : Block D and the South half of Block C of Tract No. 570, as shown on a map recorded in book 19, page 41 of Mis- cellaneous Maps, records of Orange County, California. Excepting therefrom the southerly five acres of Block D. Parcel 2 : The South half of the East half of the Northeast quarter of the Northwest quarter of the Northeast quarter of Section 35, Township 5 South, Range 11 West in the Rancho Las Bolsas, as shown on a map recorded in book 51 , page 7 and following of Miscellaneous Maps , records of Orange County, California. Excepting therefrom all minerals , gas , oil, petroleum, naptha and other hydrocarbon substances in and under JG:ps 4/26/79 1. said land, together with all necessary and convenient rights to explore for, develop, produce, extract and take the same subject to the express limitation that any and all operations for the exploration, development, production, extraction and taking of any of said sub- stances shall be carried on at levels below the depth of 500 feet from the surface of said land by means of mines , wells, derricks and/or other equipment from sur- face locations on adjoining or neighboring land lying outside the above described land and subject further to the express limitation that the foregoing reservation shall in no way be interpreted to include any right of entry in and upon the surface of said land. Parcel 3: The east 10 feet of the northwest quarter of the north- east quarter of the northwest quarter of the northeast quarter of Section 35 , Township 5 South, Range 11 West. SECTION 2. The City Administrator is hereby directed and authorized to sell said surplus property at public auction for not less than its appraised fair market value, reserving there- from any necessary easements for street and public utility pur- poses , in accordance with appropriate city ordinances .
