HomeMy WebLinkAboutCity Council - 4951 RESOLUTION NO. 4951 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF STORM DRAIN EASEMENTS LOCATED NORTH OF CENTER DRIVE AND WEST OF BEACH BOULEVARD WHEREAS, on December 1, 1980 the City Council of the City of Huntington Beach duly adopted Resolution No. 4944 declaring its intention to vacate two storm drain easements generally lo- cated north of Center Drive and west of Beach Boulevard, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of January 5, 1981 at the hour of 7: 30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed va- cation were posted conspicuously along the two storm drain ease- ments, and such notices were posted not more than three hundred ( 300) feet apart and at least three (3) were posted. On January 5, 1981 at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all per- sons interested in or objecting to the proposed vacation of two storm drain easements, generally located north of Center Drive and west of Beach Boulevard, at which time no objection was made to said vacation, and evidence was presented showing that the two storm drain easements proposed to be vacated are not necessary for present and prospective public street pur- poses and are not suitable for use or development as bicycle paths or routes. /ahb 11/26/80 1. NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320, does resolve that two storm drain easements , generally located north of Center Drive and west of Beach Boulevard are not necessary for present or prospective public street purposes, and are not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that the two storm drain easements, generally lo- cated north of Center Drive and west of Beach Boulevard, be and the same are hereby vacated; and said storm drain easements so vacated are more particularly described as follows: Parcel 1 : An easement for storm drain purposes, 20. 00 feet wide, over those portions of Parcels 6 and 7 in the city of Huntington Beach, County of Orange, State of California, as shown on a map filed in Book 144, pages 31, 32 and 33 of Parcel Maps in the office of the County Recorder of said county, lying 10.00 feet on each side of the fol- lowing described centerline: Beginning at the southwesterly terminus of the course shown as north 3903410411 east 148. 83 feet on page 33 of said map, thence north 3903410411 east 148.83 feet to the beginning of a curve concave southerly having a radius of 22.50 feet; thence northeasterly, easterly and southeasterly 35. 34 feet along said curve through a central angle of 90100100" ; thence south 50025 '56" east 59. 72 feet to the beginning of a curve concave northerly having a radius of 22. 50 feet; thence southeasterly and easterly 26.10 feet along said curve through a central angle of 66027122" to the northeasterly line of said Parcel 6.
