A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AUTHORIZING DESTRUCTION OF
PERSONNEL RECORDS
WHEREAS , Government Code sections 34090 and 34090. 5 pre-
scribe the manner in which public records may be destroyed ; and
The Chief of Administrative Services has requested permis-
sion to destroy certain personnel records which do not fall
within the excepted categories listed in the aforementioned
code sections; and
The City Attorney of the City of Huntington Beach hereby
consents to the destruction of such personnel records , pursuant
to the above mentioned code sections , and upon approval of the
City Council ,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that approval is hereby given for
descruction of
1. The following personnel records of persons whose employ-
ment by the city terminated not less than five ( 5) years ago :
(a) Personnel files.
(b) Medical files of persons formerly employed by the
city who have not received a disability retirement.
(c) Files of resolved grievances.
2. The following personnel records over three (3) years
old
(a) Personnel applications of persons who were not
employed by the city.
(b) Application log sheets.
(c) Job announcements and advertisement copy for open
recruitment.
(d) Test questions , scoring keys , and other examina-
tion data.

3. The following personnel records over two (2) years old :
miscellaneous interdepartmental and interagency memoranda, cor-
respondence files , material requisitions , preliminary drafts and
notes maintained in the Personnel Division of the Department of
Administrative Services.
4. Provided , however , that nothing herein shall be construed
to permit destruction of records required to be maintained by
Government Code section 34090 or records of persons who have filed
any litigation or charge of discrimination which has not resulted
in a final judgment or settlement.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 7th
day of December , 1981.

CONSENT OF CITY ATTORNEY FOR THE
DESTRUCTION OF PERSONNEL RECORDS
The undersigned, GAIL HUTTON, City Attorney of the City
of Huntington Beach, pursuant to California Government Code
section 34090 and at the request of the Personnel Director,
hereby consents to the destruction of those certain personnel
records described in the foregoing resolution.

that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
