HomeMy WebLinkAboutCity Council - 5062 RESOLUTION NO. 5062 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF YORKTOWN AVENUE EAST OF MAIN STREET The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1. A public meeting was held before the Planning Commission on November 3, 1981 at which time it was deter- mined, pursuant to Government Code section 65402, that the proposed vacation of a portion of Yorktown Avenue east of Main Street conformed to the city ' s general plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code (sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Yorktown Avenue east of Main Street more particularly described as follows : That portion of Section 2, Township 6 South, Range 11 West in the Rancho Las Bolsas , city of Huntington Beach, County of Orange, State of California, as shown on a map recorded in Book 51, page 14 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : Beginning at the intersection of a line para- llel with and 60 .00 feet west, measured at right angles from the west line of Block 2002, Tract No. 12 recorded in Book 9, page 13 of Miscellaneous Maps , Records of Orange County, and a line parallel with and 50 .00 feet north, measured at right angles from the north line of said Block 2002 ; thence north 89059145" east 360 feet along said last mentioned para- llel line; thence north 0°00 ' 15" west 20. 00 feet; thence north 89059145" east 223. 83 feet along a line parallel with and 70 .00 feet north, measured at right angles from the north line of said Block 2002 to the true point of beginning, ahb 12/4/81 1. said point lies on a nontangent curve con- cave to the southwest, having a radius of 850.00 feet , a radial line to said point bears north 15015 , 49" east; thence south- easterly along said curve through a central angle of 04109102" an arc distance of 61. 57 feet; thence north 48°41 ' 56" west 27 .80 feet; thence south 89059145 " west 37. 88 feet to the true point of beginning. SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the par- ticulars of the proposed vacation of a portion of Yorktown Avenue east of Main Street, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix January 18, 1982 at the hour of 7 :30 p.m. , or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach Independent, a newspaper of general circulation within fifteen ( 15) days of the passage of this resolution. SECTION 6. The Director of Public Works is directed to post, or cause to be posted, notices of vacation conspicuously along that portion of Yorktown Avenue east of Main Street proposed to be vacated at least ten (10) days before the date of the hearing. Such notices shall be posted not more than three hundred (300) feet apart, but at least three (3) shall be posted. Such no- tices shall state the passage of this resolution of intention and the time and place of hearing. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 21st. day of _December 1981. 2.
