HomeMy WebLinkAboutCity Council - 5086 RESOLUTION NO. 5086 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF SUGAR AVENUE NORTH OF MC FADDEN AVENUE WHEREAS, on December 21 , 1981 the City Council of the City of Huntington Beach duly adopted Resolution No. 5061 declaring its intention to vacate a portion of Sugar Avenue north of McFadden Avenue, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed va- cation; and Said resolution fixed the time and place of January 18, 1982 at the hour of 7 :30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen ( 15) days from the passage of said resolution. Notices of the proposed vaca- tion were posted conspicuously along Sugar Avenue north of McFadden Avenue, and such notices were posted not more than three hundred (300) feet apart and at least three (3 ) were posted. On January 18, 1982 at the hour of 7 :30 p .m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of a portion of Sugar Avenue north of McFadden Avenue, at which time no objection was made to said vacation, and evidence was pre- sented showing that that portion of Sugar Avenue proposed to be vacated is not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington /ahb 12/29/81 1. Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with section 8320, does re- solve that that portion of Sugar Avenue north of McFadden Avenue is not necessary for present or prospective public street pur- poses, and is not suitable for use or development as bicycle path or routes, and it is hereby ORDERED that such portion of Sugar Avenue north of McFadden Avenue be and the same is hereby vacated; and said portion of Sugar Avenue so vacated is more particularly described as follows : That portion of the east half of the southeast quarter of Section 14 , Township 5 South, Range 11 West , in the Rancho La Bolsa Chica, city of Huntington Beach, County of Orange, State of California, as per map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : Beginning at the northwest corner of said east half, said corner being on the centerline of Sugar Avenue, 40 .00 feet wide, as shown on a map of Tract No. 4033, Book 145, pages 1 and 2 of Miscellaneous Maps , records of said county; thence along the westerly line of said east half, south 00°39' 08" east 30.00 feet to the true point of beginning; thence continuing along said westerly line south 00039108" east 80. 78 feet to a point in the northerly line of McFadden Avenue, 40.00 feet measured at right angles from the survey centerline of re- located McFadden Avenue as shown on state Highway Map No. F 1895 on file in the office of the County Surveyor of said county; thence along said northerly line, north 68059 '50 " east 42. 64 feet to a tangent curve concave northwesterly having a radius of 25. 00 feet ; thence along said curve through a central angle of 97039127" an are distance of 42. 61 feet to the beginning of a compound curve con- cave southwesterly- having a radius of 58. 00 feet, a radial through said point bears north 61020123" east, thence along last mentioned curve through a central angle of 61048 '37" an arc distance of 62.57 feet to a point south 0028114" east, 30. 00 feet measured at right 2. angles from the centerline of Sugar Avenue; thence south 89031146/, west, parallel with and 30 .00 feet southerly of the centerline of Sugar Avenue 2.33 feet to the true point of beginning.
