A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH SUPPORTING THE CURRENT ORGANIZA-
TIONAL STRUCTURE OF THE COUNTY SANITATION DIS-
TRICTS AND OPPOSING ANY LEGISLATIVE CHANGE TO
PLACE SUCH DISTRICTS UNDER A GOVERNING BOARD COM-
PRISED SOLELY OF THE COUNTY BOARD OF SUPERVISORS
WHEREAS, the Sanitation Districts of Orange County Waste-
water Quality Control System throughout metropolitan Orange
County is the third largest on the West Coast, serving a current
population of 1. 8 million persons ; and
The existing seven sanitation districts operate under a
joint administrative organization agreement for the purpose
of owning and operating wastewater collection and treatment fa-
cilities under a single management; and
The county sanitation districts presently provide service
to twenty-three of the twenty-six cities, plus unincorporated
territory in the County of Orange, including the city of
Huntington Beach; and
Over 90 percent of the area served by the districts is
within the boundaries of incorporated cities that exercise
planning and development authority; therefore, the City of
Huntington Beach has a vested interest in the administration
of the districts ; and
The necessity for intercity or metropolitan sewage planning
and operation was early recognized in Orange County, specifically
by the formation of the Joint Outfall Sewer Organization in 1923
which preceded the present county sanitation districts and in-
cluded service areas for eight cities; and
The utilization of a joint venture for sewage facilities
between various independent cities and sanitary districts is
still recognized as a practical necessity and a desirable form

of government which results in obvious savings and efficiency
while continuing to retain local entity control through representa-
tion on its Board of Directors; and
The seven county sanitation districts were formed and organized
in 1947 and 1948 following a comprehensive engineering study and
report followed by recommendation of the county Board of
Supervisors; and
The district boundaries were established on the basis of
geography, topography and existing city and sanitary district
boundaries; and
The local collection of wastewater is accomplished by local
systems owned and operated by the respective cities or sanitary
districts, which systems then transport the wastewater to the
sanitation districts' trunk sewer system and treatment plant

facilities ; and
The Sanitation Districts of Orange County were formed pur-
suant to the County Sanitation District Act (Health and Safety
Code sections 4700 et seq. ) ; and
Under the County Sanitation Act the board of directors is
composed of the mayor of each city, a member of the governing
board of each sanitary district , and the chairman of the county
board of supervisors which assures every local agency of ade-
quate representation on any sanitary district governing board; and
The Chairman of the Board of Supervisors has requested
specific legislation placing control with the Board of Supervisors
because a stalemate occurred between the county and the sani-
tation districts concerning the allocation of ad valorem tax
revenues for annexations of new territory to the sanitation dis-
tricts ; and
On May 25, 1982, the Orange County Board of Supervisors
adopted a a resolution asking the California legislature to place
sanitation districts under the exclusive control of the Board
of Supervisors, and if such legislation is enacted, local agency
control would be lost to 1 .8 million consituents in Orange County

who have been represented for the past thirty-five years ,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach as follows :
SECTION 1. That A.B. 1601 (Thurman) now being considered
by the state legislature is hereby opposed in its entirety, and
its defeat is urged.
SECTION 2. That any legislation that would amend the County
Sanitation District Act , particularly Health and Safety Code
section 4730, or any other legislative enactment which would
change the composition of the governing body of the Orange
County Sanitation Districts as they presently exist, is opposed
and each member of the legislature is requested to resist such
legislation.
SECTION 3. That the California League of Cities and each
Orange County legislator is asked to take positive action toward
preventing the adoption of any legislation, including A.B. 16013
which would abolish local agency control of the sanitation dis-
tricts in Orange County in order to place such districts under
the exclusive control of the Orange County Board of Supervisors.
SECTION 4. The City Clerk is directed to forward copies of
this resolution to the appropriate members of the state Legislature
and the California League of Cities.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at an adjourned regular meeting thereof held
on the 14t_h day of June 1982.

that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular adjourned meeting thereof held on the 14th day
of June , 19 82 by the following vote:
