HomeMy WebLinkAboutCity Council - 5138 RESOLUTION NO. 5138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRES THE DISPOSI- TION OF CERTAIN SURPLUS PROPERTY, GENERALLY LOCATED ON ALABAMA STREET WEST OF MEMPHIS AVENUE WHEREAS, the City of Huntington Beach is the owner of certain real property, generally located on Alabama Street west of Memphis Avenue, and more particularly described as : Lots 1 and 2 in Block 1401 of T. J. Watson' s Subdivision, as shown on a map recorded in Book 4, page 56 of Miscellaneous Maps, records of Orange County, California. Lots 1 through 10 of the Summit Tract, as shown on a map recorded in Book 7, page 1 of Miscellaneous Maps , records of Orange County, California. That portion of Mosher Avenue (now known as Nashville Street) as shown on a map of Watson' s Addition to Huntington Beach, recorded in Book 3 , page 39 of Miscellaneous Maps , records of Orange County, California, described as follows : Beginning at the southwest corner of Lot 1 in Block 1401 of T. J. Watson' s Subdivision as shown on a map recorded in Book 4 , page 56 of Miscellaneous Maps , records of Orange County, California, and running east along the southerly line of said Lot 1 to the southeast corner thereof; thence south along the southerly ex- tension of the easterly line of said Lot 1 to the northeasterly corner of Lot 10 of the Summit Tract, as shown on a map recorded in Book 7 , page 1 of Miscellaneous Maps , records of Orange County, California; thence west along the northerly line of said Lot 10 and along its westerly extension to the point of intersection of the southerly extension of the westerly line of said Lot 1 ; thence north along said southerly ahb 6/29/82 1. i extension of the westerly line of said Lot 1 to the point of beginning. and j The City Administrator has recommended to this Council that such real property be declared surplus ; and Huntington Beach Municipal Code section 3 .06.010 (b) au- thorizes the city to dispose of surplus property, and sets out procedures therefor, NOW, THEREFORE, the City Council of the City of Huntington Beach does find, determine and resolve as follows : SECTION 1. That the real property described hereinabove is surplus and that the public interest and necessity requires the disposition thereof. SECTION 2. That the City of Huntington Beach acquired such real property by grant deed from Elmar and Amy Tufts, Roy and Margaret Bott, and Mabel Meyer, Constance Perry and H. D. Perry. SECTION 3. That an independent appraisal shall be obtained to establish the fair market value of the real property sought to be disposed of, and such fair market value appraisal shall also include the cost of city' s preparing land for sale and appraisal fees. SECTION 4. That the real property herein declared surplus shall be sold for cash. SECTION 5. The City Administrator is hereby authorized and directed to execute all documents and take all steps necessary to dispose of such surplus real property, pursuant to the de- terminations of this Council and the procedures set forth in section 3.06. 010 of the Huntington Beach Municipal Code. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 6th day of July , 1982. 2.
