HomeMy WebLinkAboutCity Council - 5153 i RESOLUTION NO. 5153 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CERTIFYING AS TO ITS REVIEW OF THE FINAL EIR WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE YORKTOWN-LAKE REDEVELOPMENT PROJECT AND MAKING CERTAIN FINDINGS WHEREAS, the Redevelopment Agency of the City of Huntington Beach (the "Agency") has prepared and approved a Draft EIR with respect to the adoption of a Redevelopment Plan (the "Redevelopment Plan") for the Yorktown-Lake Redevelopment Project (the "Project") ; and WHEREAS, pursuant to notice duly given, the Agency and the City Council of the City of Huntington Beach have held a full and fair public hearing on the proposed Redevelopment Plan and Draft EIR. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1: A full and fair public hearing having been held on said Draft EIR and the City Council having considered all comments received thereon, which comments and responses thereto have been attached to said Draft EIR and incorporated therein, the Draft EIR is hereby approved and adopted as the Final EIR for the adoption of the Redevelopment Plan. SECTION 2: The City Council hereby certifies that the Final EIR for the Redevelopment Plan has been completed in compliance with the California Environmental Quality Act of 1970 and the State and local environmental guidelines and regulations and that it has reviewed and considered the Final EIR and the information contained therein. SECTION 3: The City Council hereby finds with respect to the adverse environmental impacts detailed in the Final Environmental Impact Report: a. That the adverse environmental impacts associated with the adoption of the Redevelopment Plan have been considered and recognized by the City Council. b. The comments and responses made during the public hearing of the Agency and City Council have been considered and recognized by the City Council and have been incorporated into the Final EIR. C. That, based on the information set forth in the Final EIR, the City Council finds and determines that measures to mitigate certain environmental impacts i exist and are included in the Final EIR. i II d. That as to certain adverse impacts associated with long-term environmental quality, the City Council finds and determines that said adverse impacts cannot be entirely mitigated due to the involvement of activities outside the jurisdiction of the Agency and the City of Huntington Beach. SECTION 4 : The City Council hereby finds and determines that all potential impacts on the environment cannot be entirely or feasibly eliminated. The City Council hereby finds that the beneficial economic and social effects of the Project override such potential adverse impacts. SECTION 5: The City Council hereby finds and determines that all measures have been incorporated into the Redevelopment Plan which will mitigate or avoid any significant environmental effects that can feasibly be mitigated or avoided. SECTION 6: The City Clerk of the City of Huntington Beach is -hereby- authorized and directed to file with the County Clerk of the County of Orange, a Notice of Determination, pursuant to 14 California Administrative Code Section 51085 (h) . SECTION 7 : This resolution shall take effect immediately upon its adoption. PASSED AND ADOPTED this 7th day of September , 1982.
