HomeMy WebLinkAboutCity Council - 5186 RESOLUTION NO. 5186 j A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF YORKTOWN AVENUE EAST OF HUNTINGTON STREET I The City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. A public meeting was held before the Planning I Commission on September 8, 1982 at which time it was determined, pursuant to Government Code section 65402, that the proposed vacation of a portion of Yorktown Avenue east of Huntington Street conformed to the city' s general plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code ( sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Yorktown Avenue east of Huntington Street more particularly described as follows: PARCEL 1 : Beginning at the southeast corner of Lot 2503 of East Side Villa Tract , as shown on a map recorded in Book 4, page 65 , Miscellaneous Maps , Records of Orange County; thence westerly 120. 06 feet along the south line of said Lot 2503 to the true point of beginning; thence continuing along said south Line north 89 °59 '38" west 179. 94 feet to a - point, said point being the southwest corner of Lot 2503 ; thence south 0000 ' 17" east 12. 18 feet to the beginning of a tangent curve; said curve being concave northeasterly and having a radius of 32.00 feet; then southerly and easterly along said curve through a center angle of 33 °50 '32" , an arc distance of 18. 90 feet to a point, a radial line through said point bears north 5610912211 east; thence south 8905912511 east 69. 83 feet along said line to a point on a nontangent curve, said curve being concave southeasterly and having a radius of ahb 10/8/82 1. 861 . 15 feet . A radial line through said point bears north 19036145" west; thence easterly along said curve through a center angle of 70151001' , an arc distance of 108. 97 feet to the true point of beginning. PARCEL 2: Beginning at the southwest corner of Lot 2503 of East Side Villa Tract , as shown on a map recorded in Book 4, page 65, Miscellaneous Maps , Records of Orange County; thence south 0000 ' 17" east 12.18 feet to the beginning of a tangent curve concave northeasterly and having a radius of 32.00 feet, thence southerly and easterly along said curve through a central angle of 33050 ' 32" , an arc distance of 18.90 feet to the true point of beginning, said point being a nontangent line, a radial line through said point bears north 56009122" east; thence south 89059125" east 69. 83 feet along said line to a point on a nontangent curve concave southeasterly and having a radius of 861. 15 feet , a radial line through said point bears north 19036145" west; thence southerly and westerly along said curve through a center angle of 2 013 ' 51" , an arc distance of 33. 53 feet to a point of reverse curve, said curve being concave northeasterly and having a radius of 32.00 feet, a radial line through said point bears north 21°50 ' 36" west; thence westerly along said curve through a central_ angle of 78000 ' 13" , an arc distance of 43. 57 feet to the true point of beginning. The city hereby reserves and excepts from the vacation a per- manent easement and right at any time or from time to time, to con- struct, maintain, operate, replace, remove and renew storm drains , sanitary sewers, water mains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be va- cated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace , remove, renew and enlarge lines of pipe , conduits , cables, wires , poles , and other convenient structures , equipment and fixtures for the operation of gas pipelines , telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products , ammonia, water, and 2. incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over such street or part thereof proposed to be vacated. SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the par- ticulars of the proposed vacation of a portion of Yorktown Avenue east of Huntington Street, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix December 63 1982 at the hour of 7: 30 p.m., or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15 ) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in a newspaper published and circulated in Huntington Beach for at least two successive weeks prior to the time set herein for the public hearing. SECTION 6. The Director of Public Works is directed to post, or cause to be posted, notices of vacation conspicuously along that portion of Yorktown Avenue east of Huntington Street proposed to be vacated at least two weeks before the date of the hearing. Such notices shall be posted not more than three hundred ( 300 ) feet apart, but at least three (3 ) shall be posted. The notices shall state the day, hour, and place of hearing and shall refer to the adoption of this resolution of intention, and shall de- scribe that portion of Yorktown Avenue east of Huntington Street proposed to be vacated, or shall. include a map or plan showing the location of the proposed vacation. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 15th day of November 1982. 3.
