HomeMy WebLinkAboutCity Council - 5199 RESOLUTION NO. 5199 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF YORKTOWN AVENUE EAST OF HUNTINGTON STREET WHEREAS, on November 15, 1982 the City Council of the City of Huntington Beach duly adopted Resolution No. 5186 declaring its intention to vacate a portion of Yorktown Avenue east of Huntington Street, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed va- cation; and Said resolution fixed the time and place of December 6, 1982 at the hour of 7: 30 p .m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed va- cation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along that portion of Yorktown Avenue east of Huntington Street proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On December 6 , 1982 at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of Yorktown Avenue east of Huntington Street, at which time no objection was made to said vacation, and evidence was presented showing that that portion of Yorktown Avenue proposed to be vacated is not nec- essary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington /ahb 11/23/82 1. Beach, pursuant to Division 9 , Part 3, Chapter 2 of the 'California Streets and Highways Code, commencing with Section 8320, does resolve that a portion of Yorktown Avenue, east of Huntington Street, is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that a portion of Yorktown Avenue, east of Huntington Street, be and the same is hereby vacated; and said portion of Yorktown Avenue so vacated is more particularly described as follows : PARCEL 1: Beginning at the southeast corner of Lot 2503 of East Side Villa Tract , as shown on a map recorded in Book 4, page 65, Miscellaneous Maps , Records of Orange County; thence westerly 120. 06 feet along the south line of said Lot 2503 to the true point of beginning; thence continuing along said south line north 89059 ' 38" west 179. 94 feet to a point, said point being the southwest corner of Lot 2503; thence south 0000117" east 12. 18 feet to the beginning of a tangent curve; said curve being concave northeasterly and having a radius of 32. 00 feet ; then southerly and easterly along said curve through a center angle of 33050132" , an arc distance of 18. 90 feet to a point, a radial line through said point bears north 56109122" east; thence south 89°59125" east 69 . 83 feet along said line to a point on a nontangent curve, said curve being concave southeasterly and having a radius of 861.15 feet. A radial line through said point bears north 19036 , 45" west; thence easterly along said curve through a center angle of 7015100", an arc distance of 108. 97 feet to the true point of beginning. PARCEL 2: Beginning at the southwest corner of Lot 2503 of East Side Villa Tract, as shown on a map recorded in Book 4, page 65, Miscellaneous Maps , Records of Orange County; thence south 0°00 '17" east 12. 18 feet to the beginning of a tangent curve concave northeasterly and having a radius of 32. 00 feet, thence southerly and easterly along said curve through a central angle of 33050 ' 3211 , an are distance of 18. 90 feet to the true point of beginning, said point being a nontangent line, a radial line through 2. said point bears north 56009122" east; thence south 89059125" east 69 . 83 feet along said line to a point on a nontangent curve concave southeasterly and having a radius of 861.15 feet , a radial line through said point bears north 19036145" west; thence southerly and westerly along said curve through a center angle of 2013151" , an arc distance of 33. 53 feet to a point of reverse curve, said curve being concave northeasterly and having a radius of 32. 00 feet, a radial line through said point bears north 21050' 36" west; thence westerly along said curve through a central angle of 78000113" , an arc distance of 43. 57 feet to the true point of beginning. The city hereby reserves and excepts from the vacation a per- manent easement and right at any time or from time to time, to con- struct, maintain, operate, replace, remove and renew storm drains , sanitary sewers, water mains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be va- cated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits , cables , wires , poles , and other convenient structures , equipment and fixtures for the operation of gas pipelines , telegraphic and telephone lines , railroad lines , and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes , including access and the right to keep the property free from inflammable materials , and wood growth, and otherwise protect the same from all hazards in, upon and over such street or part thereof proposed to be vacated.
