HomeMy WebLinkAboutCity Council - 5207 RESOLUTION NO. 5207 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING APPLICATION FOR A COASTAL ZONE MANAGEMENT GRANT, PHASE IV IMPLEMENTATION OF THE LOCAL COASTAL PROGRAM, FROM THE CALIFORNIA COASTAL COMMISSION TO IM-PLEMENT THE CALIFORNIA COASTAL ACT OF 1976 WHEREAS, the City of Huntington Beach recognizes the problems and issues identified in the attached work program for Phase IV Implementation of the Local Coastal Program and desires to continue to provide improved coastal planning, decision making, and management capability related to community development and growth; and The city has devised a package which deals with these problems and issues, and desires to apply to the California Coastal Commission for planning and financial assistance for such program; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby requests the California Coastal Commission to provide planning and financial assistance not to exceed Twelve Thousand Dollars ($12, 000) . Such planning assistance is more particularly described in the work program at- tached hereto and made a part hereof as though set forth herein. BE IT FURTHER RESOLVED that the City Administrator of the City of Huntington Beach be and is hereby authorized and empowered to execute on behalf of the city all necessary applica- tions, contracts, and agreements and any amendments thereto, which implement and carry out the purposes specified in this resolution. It will comply with Title VI of the Civil Rights Act of 1964 (42 USC 2000d) prohibiting employment discrimination where, (1 ) the primary purpose of a grant is to provide employment or, (2) discriminatory employment practices will result in unequal treatment of persons who are or should be benefiting from the grant-aided activity. 4. It will comply with requirements of the provisions of the Uniform Relocation Assistance and Real Property Acquisitions Act of 1970 (P.L. .91-646) which provides for fair and equitable treatment of persons displaced as a result of federal and federally assisted programs. 5. It will comply with all requirements imposed by the federal grantor agency concerning special requirements of law, program requirements, and other admi- nistrative requirements approved in accordance with Off' of Management and Budget Circular No. 74-7. ignature of Authorized Official WORK PROGRAM CITY OF HUNTINGTON BEACH LOCAL COASTAL PROGRAM ' PHASE IV: PERMITTING 1 _� 7. 9 i 1.0 CONFORMANCE REVIEW Discussion: This task is designed to insure that new development within the Coastal Zone will be adequately reviewed for compliance with the City's Coastal Land Use Plan. Staff will review the Land Use Plan to determine which policies apply to new development. Pertinent aspects of these policies must be integrated into a comprehensive conformance review process. Staff must create a review process which is efficient, while adequately addressing Coastal Act Policies. Attaining this efficiency will require integrating the coastal review process with the City's present permitting system, where possible In addition, review documents must be developed and printed for review of coastal zone development. The following forms must be developed in order to implement a comprehensive conformance review process: Coastal Permit Application Form. Developing a comprehensive permit application form requires thorough staff review of the Land Use Plan to determine which policies must be addressed. Staff must design the application to provide all information needed to adequately assess a project's compliance with Coastal Act regulations. Specifically, the permit must require de- tailed information concerning project size, type, location, and any other data needed to assess possible impacts on the coastal environment. Staff will review the City's existing permit applications to determine a plausible format for the coastal permit. Particular attention will be given to develop- ing a format which is clear, concise, and thorough. Data Checklist for Application Requirements. The purpose of this checklist is to insure that all necessary information is included for the accurate processing of coastal permit appli- cations. This will be accomplished by developing a checklist of the information required in the permit application. This screening procedure will aid in the efficient administration of the conformance review process. Exemption Form. The City's existing categorical exclusion areas will expire with certification of Phase III of the LCP. In implementing the conformance review process the City may reapply for these exclusions. In addition, staff will consult the LUP and zoning ordinances to determine other types of development which might receive an exemption from coastal review. Following these determinations, exemption forms will be developed. These forms must contain- all necessary data about the project nature and purpose. The exemption forms will serve as a permanent record of all exempt developments. Checklist for Project Review. All projects within the Coastal • one wi be checked for conformance with LUP Policies. Staff must thoroughly review the LUP and zoning ordinances in order to devise a checklist which can ,be universally applied to acti- vity within the Coastal Zone. It is important that the check- list is comprehensive and provides staff with a uniform proce- dure to follow. The checklist format should effectively screen projects for compliance with Coastal Act Policies and address all environmental impacts. Processing Flow Chart. Staff must determine the most efficient method for processing coastal permits and devise a permit routing procedure. In order to clarify this process, a flow chart will be developed. This chart will be a graphic representation of the steps involved in processing a permit application. It must be clear enough to facilitate understanding of the coastal review process by all staff involved. Objectives: - Ensure development within the City's Coastal Zone complies with Coastal Act Policies. - Implement the City's Coastal Land Use Plan and zoning i ordinances. - Establish co-ordinated review of all development activity within the Coastal Zone. Tasks: (a) Review Coastal Land Use Plan to determine which policies apply to new development. (b) Develop coastal permit application form. (c) Develop data checklist for permit application requirements. i ' (d) Review Land Use Plan and zoningg ordinances to determine types of development which could. be exempt from coastal review. (e) Develop coastal exemption form. (f) Review Land Use Plan and zoning ordinances to determine information necessary for comprehensive review of coastal projects. Planner 569/wk 14wks $8,000 w 2.0 NOTICE AND HEARING PROCEDURES Discussion: The Coastal Act outlines specific notice and hearing require- ments for different types of permit applications. Staff must review the City's notice and hearing requirements to determine the revisions necessary to achieve compliance with coastal regulations. Since regulations for appealable and non-appealable developments differ, staff will probably propose a uniform system of providing notice for all projects that will satisfy the regulations for the widest notice. In addition, staff must determine the ability of the City's existing discretionary bodies to incorporate coastal hearings into their proceedings. If deemed necessary, staff will consider the formation of a- special coastal reviewing body which will handle all coastal hearings. Following the development of a notice and hearing process, noticing forms must be developed. Staff must create a format which provides all information required by the Coastal Act including the date the application will be acted upon by the local governing body, the general procedure of the local government concerning the submission of public comments and a statement that a sufficient public comment period will be held prior to the local decision. Objectives: Ensure City notice hearing procedures comply with Coastal Act Regulations. Ensure adequate public notification of development activity within the Coastal Zone. 13_ 7 , Tasks: (a) Review Coastal Regulations to determine revisions needed to City's notice and hearing requirements. It is important that oil operations are in conformance with Coastal Act Policies. Staff must determine a method of integrating oil permitting into the coastal review process so that the necessary consistency review can be ac- complished. This method will include the development of an oil permit checklist. The checklist will serve as a guide i en sure f r will ensu or the reviewer �n assessing conformance and that oil permit applications provide all information necessary. In addition, a flow chart will be devised, depicting the routing process and staff involved in oil permit review. Objectives: Ensure that oil permits are in compliance with Coastal Act Policies.
