HomeMy WebLinkAboutCity Council - 5255 RESOLUTION NO. 5255 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENT NO. 11 TO AGREEMENT NO. 07-5181 TO IMPROVE THE SOUTHERN PACIFIC TRANSPORTATION COMPANY'S RAILROAD CROSSING NO. BAA-521. 09 ON SLATER AVENUE WHEREAS, on February 7 , 1978 the city entered into an agree- ment with the State of California for the Federal-Aid Program, identified as Agreement No. 07-5181; and Program Supplement No. 11 to the above-mentioned master agreement requires the replacement of existing crossbucks with flashing lights at the Southern Pacific Transportation Company's railroad crossing (No. BAA-521. 09) on Slater Avenue in this city; and The total cost of such public safety improvement program is $70,000 which amount will be appropriated from Federal and local funds, as shown on Exhibit B attached, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that the Mayor and City Clerk are au- thorized and directed to execute the necessary documents to im- plement Program Supplement No. 11 to Master Agreement No. 07-5181 for the purpose of improving Southern Pacific Transportation Company' s railroad crossing at Slater Avenue . The costof maintenance of the crossing shall be as allocated by Public Utilities Commission. 2. In agreeing to the construction of this pro- ject, the local agency agrees the payment of Federal funds will be limited to the detail estimate amount approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) , or its modification (PR-2A) , and accepts any increases in local agency contribution. 4. In executing this Program Supplemental Agreement, local agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. Res.
