HomeMy WebLinkAboutCity Council - 5276 RESOLUTION N0. 5276 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 83-1 WHEREAS, by Resolution No. 5271, a public hearing was called for June 20, 1983 at the hour of 7: 30 p.m. , or as soon thereafter as the matter could be heard, in Council Chambers of the Civic Center, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles , over- head wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, com- munication, or similar or associated service to those properties fronting on either side of Warner Avenue from a point one hundred (100 ) feet easterly of its intersection with Gothard Street and extending easterly to Beach Boulevard; and Notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby finds and determines that the public necessity, health, safety and welfare requires the removal of poles , overhead wires and associated structures , and the underground installation of wires and facilities for sup- plying electric, communication, or similar or associated service with_i'- that area designated as Underground Utility District No. 83-1, more particularly described as follows : That portion of sections 23 and 26 of ahb 6/9i'83 1. Township 5 South, Range 11 West in the Rancho La Bolsa Chica and Rancho Las Bolsas in the city of Huntington Beach, County of Orange, State of California as shown on a map in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county, described as follows : Beginning at a point 100 feet easterly of the centerline of Gothard Street and 150 feet north measured at _right angles from the north line of said Section 23, being called in this de- scription the centerline of Warner Avenue, thence easterly 675 feet approximately along a line parallel with and 150 feet north, measured at right angles , from the centerline of Warner Avenue to the west line of Lyndon Street, thence southerly 40 feet along the west line of Lyndon Street to a line parallel with and 110 feet north, measured at right angles , from the center- line of Warner Avenue; thence easterly 40 feet along said parallel line to the east line of Lyndon Street; thence northerly 40 feet along the east line of Lyndon Street to a line para- llel with and 150 feet north, measured at right angles from the centerline of Warner Avenue; thence easterly along said parallel line 490 feet approximately to the west line of Nichols Street; thence northerly 30 feet to a line para- llel with and 180 feet north, measured at right angles from the centerline of Warner Avenue; thence easterly along said parallel line 1,020 feet approximately to the east line of Tract No. 195, as shown on a map recorded in Book 12, page 38 of Miscellaneous Maps in the office of the County Recorder of Orange County; thence northerly 100 feet to a line parallel with and 280 feet north, measured at right angles , from the centerline of Warner Avenue; thence easterly approximately 965 _feet to a line 30 feet west of the east line of said Section 23; thence southerly 240 feet along said line to a line parallel with and 40 feet northerly measured at right angles , from the centerline at Warner Avenue, thence westerly 390 feet approximately along said para- llel line to the northerly extension of the east line of Elm Street ; thence southerly 420 feet along said extension of the east line of Elm Street to a line parallel with and 380 feet south, measured at right angles , from the centerline of 2. Warner Avenue; thence westerly 436 feet approxi- mately along said parallel line to the east line of Ash Street ; thence northerly 184 feet along the east line of Ash Street to a line para- llel with and 190 feet southerly, measured at right angles , from the centerline of Warner Avenue; thence westerly 437 feet approximately along said parallel line to the east line of Oak Street; thence northerly 40 feet along the east line of Oak Street to a line parallel with and 155 feet southerly, measured at right angles , from the centerline of Warner Avenue; thence westerly 60 feet along said parallel line to the west line of Oak Street ; thence southerly 35 feet to a line parallel with and 194 feet southerly, measured at right angles, from the centerline of Warner Avenue; thence westerly 1,075 feet ap- proximately along said parallel line to a line parallel with and 200 feet easterly, measured at right angles , from the east line of the Southern Pacific Railroad right-of-way; thence southerly 250 feet along said parallel line to a line para- llel with and 436 feet southerly, measured at right angles , from the centerline of Warner Avenue; thence westerly 160 feet along said para- llel line; thence northwesterly along a line 161 feet approximately to a point on the east line of said railroad right-of-way distant southerly 280 feet from the centerline of Warner Avenue; thence northerly along said east line of the railroad 180 feet approximately to a line parallel with and 95 feet southerly, measured at right angles, from the centerline of Warner Avenue; thence westerly 365 feet approximately along said parallel line to the west line of Palmdale Street; thence northerly 35 feet along li the northerly extension of the west line of Palmdale Street to a line parallel with and 60 feet southerly, measured at right angles , from the centerline of Warner Avenue.; thence westerly 225 feet approximately to a line Para- llel with and 100 feet east, measured at right angles from the centerline of Gothard Street ; thence northerly along said parallel line 215 feet to the point of beginning. The above described area is hereby established as Under- ground District No. 83-1. RESOLVED FURTHER that the City Council of the City of 3. Huntington Beach finds that : (a) Such undergrounding will avoid or eliminate an un- usually heavy concentration of overhead distribution facilities ; and (b ) Said street is extensively used by the general public and carries a heavy volume of pedestrian and vehicular traffic. RESOLVED FURTHER that all poles , overhead wires and as- sociated overhead structures shall be removed and underground installations made in said underground utility district within the following times: (a) Underground installation by property owners and re- connections not later than December 31, 1984 ; (b) Removal of poles , overhead wires and otherassociated overhead structures not later than July 1, 1985 by all utility companies. RESOLVED FURTHER that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Chapter 17. 64 of the Huntington Beach Municipal Code to affected property owners as such are shown on the last equalized roll and to the affected utilities .
