A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
A PORTION OF SPEER AVENUE, EAST OF CRABB LANE
WHEREAS, on July 18, 1983 the City Council of the City of
Huntington Beach duly adopted Resolution No. 5287 declaring
its intention to vacate a portion of Speer Avenue, east of
Crabb Lane, and referring to maps or plans on file in the office
of the City Clerk for particulars as to the proposed vacation; and
Said resolution fixed the time and place of August 15, 1983
at the hour of 7: 30 p .m. , or as soon thereafter as the matter
could be heard, in the Council Chambers in the Civic Center at
which time said Council meeting was adjourned for lack of a quorum
and continued to August 22, 1983 for hearing all persons interested
in or objecting to the proposed vacation. Notices of the pro-
posed vacation were posted conspicuously along that portion of
Speer Avenue proposed to be vacated, and such notices were posted
not more than three hundred (300) feet apart and at least three
(3) were posted.
On August 22, 1983 at the hour of 7: 30 p.m. , in the Council
Chambers in the Civic Center, the City Council of the City of
Huntington Beach did convene for the purpose of hearing all per-
sons interested in or objecting to the proposed vacation of a
portion of Speer Avenue, at which time no objection was made to
said vacation, and evidence was presented showing that the por-
tion of Speer Avenue proposed to be vacated is not necessary for
present and prospective public street purposes and is not suitable
for use or development as bicycle paths or routes .
NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9 , Part 3, Chapter 2 of the California

Streets and Highways Code, commencing with Section 8320, does
resolve that that portion of Speer Avenue , east of Crabb Lane
is not necessary for present or prospective public street
purposes, and is not suitable for use or development as
bicycle paths or routes, and it is hereby
ORDERED that a portion of Speer Avenue, east of Crabb Lane,
be and the same is hereby vacated; and said portion so vacated
is more particularly described as follows :
Parcel 1: Beginning at the southwest
corner of Parcel 4 as shown on a map re-
corded in Book 41, page 34 , Parcel Maps ,
Records of Orange County, California;
thence north 89026117" east 280. 7 feet
along the south line of said Parcel 4 to
a point, thence south 0033143" east 3. 00
feet to a point on a line, said line
being parallel with and distant 3. 00 feet
measured at right angles from said south
line of Parcel 4; thence south 89026' 17"
west 280. 06 feet to a point; thence north
0045' 38" west 3. 00 feet to the point of
beginning.
Parcel 2: Beginning at the southeast
corner of Parcel 4 as shown on a map re-
corded in Book 70, page 24, Parcel Maps ,
Records of Orange County, California;
thence south 89026, 17" west 109 .85 feet
to a point on a tangent curve, said curve
being concave southeasterly and having
a radius of 80. 00 feet ; thence westerly
and southerly along said curve through
a central angle of 43034143" an arc dis-
tance of 60. 85 feet to a point on a line
a radial bearing through said point bears
north 440081. 26" west; thence south 0045143"
east along said line 4.20 feet to a point
on a nontangent curve, said curve being
concave southeasterly and having a radius
of 77. 0 feet; thence northerly and easterly
along said curve through a central angle
of 45043 ' 3611 , an arc distance of 61. 45
feet to a .point on a line, a radial bearing
through said point bears north 46017' 19"
west; thence north 89026, 17" east 109 . 85
feet along said line to a point ; thence

of beginning.
The city hereby reserves and excepts from the vacation a
permanent easement and right at any time or from time to time,
to construct, maintain, operate, replace, remove and renew
storm drains, sanitary sewers and water mains, and appurtenant
structures in, upon, over and across such street or any portion
thereof ordered to be vacated and pursuant to any existing fran-
chises or renewals thereof, or otherwise to construct , maintain,
operate, replace, remove, renew and enlarge lines of pipe, con-
duits, cables , wires, poles, and other convenient structures,
equipment and fixtures for the operation of gas pipelines, tele-
graphic and telephone lines, railroad lines, and for the transpor-
tation or distribution of electric energy, - petroleum and its
products , ammonia, water, and incidental purposes, including
access and the right to keep the property free from inflammable
materials , and wood growth, and otherwise protect the same from
all hazards in, upon and over such street or part thereof pro-
posed to be vacated.
PASSED AND ADOPTED by the City Council of the City of
djourned
Huntington Beach at a regular meeting thereof held on the 22nd
day of August 1983.
