A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH REQUESTING THE COUNTY OF
ORANGE TO UNDERTAKE THE DEFENSE OF THE CITY
IN THE MATTER OF SOUTHERN PACIFIC TRANSPORTATION
COMPANY, ET AL. V. BOARD OF EQUALIZATION OF THE
STATE OF CALIFORNIA., ET AL. , CASE NO. 810433
WHEREAS, Southern Pacific Transportation Company and other
railroad companies have brought suit against the Board of
Equalization of the State of California, the County of Orange,
the City of Huntington Beach, and other cities , counties and
revenue districts for taxes collected on rail transportation
property by the defendant counties on behalf of the defendant
cities and other revenue districts; and
Section 5149 of the California Revenue and Taxation Code
provides that when such a suit is filed, a city may call upon
the county to undertake the defense of the action,
14 NOW., THEREFORE, BE IT RESOLVED that the City Council of
the City of Huntington Beach hereby requests the County of
Orange to undertake the defense of the City of Huntington Beach
in the matter of Southern Pacific Transportation Company, et al.
v. Board of Equalization of the State of California, et al. ,
Superior Court for the City and County of San Francisco Case
No. 810433.
PASSED AND ADOPTED by the City Council of the City of

day of October 1983.
