HomeMy WebLinkAboutCity Council - 5342 RESOLUTION NO. 5342 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF KOLEDO LANE, NORTH OF SLATER AVENUE The City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. A public meeting was held before the Planning Commission on December 6, 1983 at which time it was determined, pursuant to Government Code section 65402, that the proposed va- cation of a portion of Koledo Lane, north of Slater Avenue , con- formed to the city's general plan. SECTION 2. Pursuant to Division 9 , Part 3, Chapter 2 of the California Streets and Highways Code (sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Koledo Lane , north of Slater Avenue, more particularly described as follows: That portion of Koledo Lane , a 60.00 foot wide street , as shown on a map of Tract No. 4301, recorded in Book 177 , pages 11 and 12 of Miscellaneous Maps, records of Orange County, California, described as follows : Beginning at the southeast corner of Lot 3 r of said Tract 4301; thence north 0144, 4611 west 480. 35 feet along the east line of Lots 3 through 10, inclusive , of said Tract 4301 to the northeast corner of said Lot 10; thence north 89024138/1 east , 60 . 00 feet to the northwest corner of Lot 36 of said Tract 4301; thence south 0144, 4611 east, 480 . 35 feet along the west line of Lots 36 and 43, inclusive, of said Tract 4301 to the southwest corner of said Lot 43; thence south 89024, 161, west, 60.00 feet to the point of beginning. The city hereby reserves and excepts from the vacation a ahb 12/16/83 1 permanent easement and right at any time or from time to time , to construct , maintain, operate, replace, remove and renew storm drains, sanitary sewers and water mains , and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing fran- chises or renewals thereof, or otherwise to construct , maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits , cables, wires , poles , and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and tele- phone lines , railroad lines, and for the transportation or distri- bution of electric energy, petroleum and its products , ammonia, water, and incidental purposes , including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over such street or part thereof proposed to be vacated. SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the par- ticulars of the proposed vacation of Koledo Lane, north of Slater Avenue, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix February 6, 1984 at the hour of 7 : 30 p.m. , or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in a weekly newspaper, published and circulated in Huntington Beach for at least two successive weeks prior to the time set herein for the public hearing. SECTION 6. The Director of Public Works is directed to post , or cause to be posted, notices of vacation conspicuously along that portion of Koledo Lane, north of Slater Avenue, proposed to be va- cated at least two weeks before the date of the hearing. The 2. i notices shall be posted not more than 300 feet apart, but at least three notices shall be posted. The notices shall state the day, hour, and place of hearing and shall refer to the adoption of this resolution of intention, and shall describe that portion of Koledo Lane proposed to be vacated, or shall in- clude a map or plan showing the location of the proposed va- cation.
