HomeMy WebLinkAboutCity Council - 5353 RESOLUTION NO. 5353 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF KOLEDO LANE, NORTH OF SLATER AVENUE WHEREAS., on January 3, 1984 the City Council of the City of Huntington Beach duly adopted Resolution No. 5342 declaring its intention to vacate a portion of Koledo Lane, north of Slater Avenue, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of February 6 , 1984 at the hour of 7 : 30 P.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation,, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vaca- tion were posted conspicuously along such portion of Koledo Lane, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On February 6 , . 1984 at the hour of 7 : 30 P.m. , in the Council Chambers in the Civic Center,, the City Council of the City of Huntington Beach did convene for the purpose of hearing all per- sons interested in or objecting to the proposed vacation of a portion of Koledo Lane, north of Slater Avenue, at which time no objection was made to said vacation, and evidence was pre- sented showing that such portion of Koledo Lane is not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 2 of the California ahb 1/17/84 1. L Streets and Highways Code, commencing with Section 8320, does resolve that that portion of Koledo Lane, north of Slater Avenue is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that a portion of Koledo Lane, north of Slater Avenue be and the same is hereby vacated; and said portion of Koledo Lane so vacated is more particularly described as follows : That portion of Koledo Lane, a 60. 00 foot wide street ,, as shown on a map of Tract No. 4301., recorded in Book 177, pages 11 and 12 of Miscellaneous Maps, records of Orange County, California, described as follows • Beginning at the southeast corner of Lot 3 of said Tract 4301; thence north 0144 , 4611 west 480. 35 feet along the east line of Lots 3 through 10, inclusive, of said Tract 4301 to the northeast corner of said Lot 10; thence north 89124 '3811 east, 60. 00 feet to the northwest corner of Lot 36 of said Tract 4301; thence south 0144 , 4611 east , 480. 35 feet along the west line of Lots 36 and 43, inclusive , of said Tract 4301 to the southwest corner of said Lot 43; thence south 891201611 west , 60 . 00 feet to the point of beginning. The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct , maintain, operate, replace, remove and renew storm drains., sanitary sewers and water mains, and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing fran- chises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires , poles, and other convenient structures , equipment and fixtures for the operation of gas pipelines, telegraphic and tele- phone lines, railroad lines , and for the transportation or distri- bution of electric energy, petroleum and its products , ammonia, 2. water, and incidental purposes, including access and the right to keep the property free from inflammable materials , and wood growth, and otherwise protect the same from all hazards in, upon and over such street or part thereof proposed to be vacated.
