HomeMy WebLinkAboutCity Council - 5358 RESOLUTION NO. 5358 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF PALM AVENUE NORTH OF CHERRY HILL DRIVE WHEREAS, on February 6, 1984 the City Council of the City of Huntington Beach duly adopted Resolution No. 5351 declaring its intention to vacate a portion of Palm Avenue , and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of March 5, 1984 at the hour of 7 : 30 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the pro- posed vacation, which time was not less than fifteen (15 ) days from the passage of said resolution. ' Notices of the proposed i vacation were posted conspicuously along a portion of Palm Avenue north of Cherry Hill Drive, and such notices were posted not more than three hundred (300 ) feet apart and at least three (3) were posted. On March 5, 1984 at the hour of 7 : 30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of Palm Avenue, at which time no objection was made to said vaca- tion, and evidence was presented showing that such portion of Palm Avenue is not necessary for present and prospective public street purposes and is not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington i /ahb 2/21/84 1. Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with section 8320, does resolve that a portion of Palm Avenue north of Cherry Hill Drive is not necessary for present or prospective public street pur- poses , and is not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that a portion of Palm Avenue be and the same is hereby vacated; and said portion so vacated is more particularly described as follows: That portion of Palm Avenue in the City of Huntington Beach, County of Orange, State of California, as shown on the map filed in Book 166, pages 10 and 11 of Parcel Maps in the office of the County Recorder of said county, described as follows : Beginning at the most westerly corner of Parcel 2, as shown on said map, said corner being on the northeasterly line of said Palm Avenue, said corner also being on a curve concave northeasterly having a radius of 850. 00 feet ; thence along said northeasterly line of said Palm Avenue the following courses : southeasterly 170. 79 feet along said curve through a central angle of 11°31 + 28" , south 46103128" east 1505. 13 feet to the beginning of a tangent curve concave northeasterly having a radius of 850. 00 feet , and southeasterly 117. 94 feet along said curve through a central angle of 7057100" to a point of cusp with a tangent curve concave northeasterly having a radius of 2514. 83 feet , a radial line to said point bears south 35059 ' 33" west ; thence north- westerly 348. 93 feet along said curve through a central angle of 7°57► 00" to a line para- llel with and 16. 00 feet southwesterly from the said northeasterly line of said Palm Avenue; thence north 46103128" west 1216. 58 feet along said parallel line to the beginning of a tan- gent curve concave northeasterly having a radius of 650. 00 feet; thence northwesterly 130. 74 feet along said curve through a central angle of 11°31128"; thence north 34°32100" west 100 . 27 feet to the point of beginning. Containing an area of 0. 559 acres, more or less. 2. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5th day of March , 1984.
