HomeMy WebLinkAboutCity Council - 5401 RESOLUTION NO. 5401 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING FEE SCHEDULE FOR ORANGE COUNTY ANIMAL SHELTER AND ANIMAL CONTROL SERVICES WHEREAS, the City of Huntington Beach has contracted with the County of Orange since 1976 for animal control services and the use of the county animal shelter; and City has incorporated by reference in the Huntington Beach Municipal Code those portions of county ordinances which relate to animal control, as required by city's contract; and The Board of Supervisors of Orange County, by resolution pursuant to county ordinances, has revised the fees for animal shelter and control services, effective July 1, 1984; and The City Council, in compliance with provisions of the Huntington Beach Municipal Code and the contract hereinbefore entered into with the County of Orange, adopts the fee schedule for animal shelter and animal control services, as set forth on Attachment A, attached hereto and by this reference made a part hereof as though set forth in full herein, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it does adopt the fee schedule for animal shelter and animal control services as set out in Attachment A, attached hereto and by this reference made a part herein, PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 18th day of June 1984. xqaa ATTEST: r City Clerk,/ REVIEWED D APPROVED: APPROVED AS TO FORM: City Administrator City Attorney INITIATED AND AP RO, ED: reasurer I r . i 1 2 3 ORDINANCE NO. 4 AN ORDINANCE OF THE COUNTY OF ORANGE, CALIFORNIA, ESTABLISHING A FEE SCHEDULE FOR ANIMAL CONTROL AND 5 ANIMAL SHELTER SERVICES PROVIDED BY THE HEALTH CARE AGENCY 6 7 The Board of Supervisors of the County of Orange, California, does hereby ordain as follows: 8 SECTION 1 . Section 8-1-10 is hereby added to Division l of Title 8 of the 9 Codified Ordinances of the County of Orange to read as follows: 10 Sec. 8-1-10. Fee Schedule for Animal Control and Animal Shelter Services. 11 A. Definitions: 12 1 . A large animal is any animal weighing 300 pounds or more. 13 2. A medium animal is any animal weighing greater than 50 pounds, but less than 3 00 pounds, 14 W� 3. A dog or cat is any animal defined as such in Ordinance No. 2836. Z, 15 t 'W0 4. An animal is as defined in Ordinance No. 2836. W 16 OZ 5. A contract cityis any municipality that has entered into a contract �o0 17 with the County of Orange for enforcement of Animal Control and u Animal Shelter Services, or for either of such services. 18 6. Actual Cost is the actual expense incurred by the County of Orange, 19 in' clud ng, but not limited to, salaries, employee benefits, overhead supplies, animal food, medication, contract services. 20 7. A kennel means any property where four (4) or more dogs, or four (4) 1 maintained 2 or more cats, over the age of four (4) months, are kept or 9 for any purpose except veterinary clinics and hospitals, and except 22 property for which an animal permit has been issued pursuant to Section 4-1-76 of the Codified Ordinances of the County of Orange. 23 8. A pet shop means any person or facility engaged in the sale or trade 24 of-live animals on a commercial basis. 25 9. A grooming arlor means any premises where animals are groomed, brushed, clipped or bathed on a commercial basis. 26 N w 27 28 / SHW:sb 1. 4-5-84 ATTACHMENT A { 1 10. An animal rental establishment means a place or facility where animals other than dogs, cats, or equines are kept or maintained 2 for hire. 3 11 . A permanent animal exhibition means any property where animals are exposed for public viewing for entertainment, instruction or 4 advertisement, including animal acts, on a regular basis, excluding activities conducted primarily for the instruction or entertainment 5 of persons for which no charge, fee, or donation is collected or solicited. 12. A commercial stable means any property where equines are sheltered 7 or fed on a commercial basis. 8 13. A circus means a carnival , tent show or show in the open air, or in a ham or building not specifically constructed for theatrical purposes, 9 wherein animals are exposed for public viewing for entertainment, instruction or advertisement. 10 14. . A rodeo means any activity or show in which equines or bovines are 11 exposed for public viewing for entertainment, instruction or advertise- ment, excluding a permanent animal exhibition, excluding activities 12 conducted primarily for the instruction or entertainment of persons for which no charge, fee, or donation is collected or solicited. 13 15. Impounded means having been received into the custody of the Health 14 Officer of Orange County or his deputy. J ZZ 15 16. A temporary animal exhibition means any activity, or property used 'W'0� for, the public viewing of animals for entertainment, instruction or VUW 16 advertisement, including. animal acts, of less than aregular basis, oZZ excluding activities conducted primarily for the instruction or 00 17 entertainment of persons for which no charge, fee or donation is collected or solicited. 18 B.
