HomeMy WebLinkAboutCity Council - 5406 RESOLUTION NO. 5406 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF DELAWARE STREET NORTH OF DETROIT AVENUE WHEREAS, on June 4, 1984 the City Council of the City of Huntington Beach duly adopted Resolution No. 5381 declaring its intention to vacate a portion of Delaware Street north of Detroit Avenue, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed va- cation; and Said resolution fixed the time and place of July 2, 1984 at the hour of 7: 30 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along that portion of Delaware Street proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On July 2, 1984 at the hour of 7 :30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of a portion of Delaware Street , at which time no objection was made to said vacation, and evidence was presented showing that that portion of Delaware Street proposed to be vacated is not necessary for present and prospective public street purposes and is not suitable for use or development as a bicycle path or route. ahb 6/20/84 1. NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with section 8320, does resolve that a portion of Delaware Street north Detroit Avenue is not necessary for present or prospective public street pur- poses, and is not suitable for use or development as a bicycle path or route, and it is hereby ORDERED that a portion of Delaware Street be and the same is hereby vacated; and said portion of Delaware Street north of Detroit Avenue so vacated is more particularly described as follows : That portion of Block 404 of "Vista del Mar Tract" in the City of Huntington Beach, County of Orange, State of California as shown on a map recorded in Book 4 , page 5 of Miscellaneous Maps in the office of the County Recorder of said county described as follows: Beginning at the southeast corner of Lot 1 of said Block 404 ; thence along the east line of Lots 1 through 7, north 014312411 , west 21. 63 feet to the true point of be- ginning; thence continuing along the east line of Lots 1 through 7, north 0143 ,44" , west 168 .18 feet to a point of cusp with a tangent curve concave to the east , having a radius of 1040 .00 feet; thence along said curve through a central angle of 7047100" an arc distance of 141.28 feet to a reverse curve concave to the northwest having a radius of 32. 00 feet ; thence along said curve through a central angle of 54000,1111 , an arc distance of 30. 16 feet to the true point of beginning. The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew storm drains, sanitary sewers and water mains, and appurtenant structures in, upon, over and across such street or any portion thereof ordered to be vacated and pursuant to any existing fran- 2. chises or renewals thereof, or otherwise to construct , maintain, operate, replace, remove, renew and enlarge lines of pipe, con- duits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipelines, tele- graphic and telephone lines, railroad lines, and for the transpor- tation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over such street or part thereof pro- posed to be vacated. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 2nd day of July 1984.
