HomeMy WebLinkAboutCity Council - 5447 RESOLUTION NO. 5447 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING AND DIRECTING THE CITY ADMINISTRATOR TO EXECUTE TRAINING PROGRAM AGREEMENTS FOR THE HUNTINGTON BEACH POLICE DEPARTMENT WITH THE CALIFORNIA HIGHWAY PATROL WHEREAS, the California Department of Highway Patrol has re- quested that the city execute certain training program agreements for its police officers with such department, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it does hereby approve the agreement with the California Department of Highway Patrol, attached hereto and by this reference incorporated herein. BE IT FURTHER RESOLVED that the City Administrator is autho- rized to execute subsequent budgeted California Department of Highway Patrol training agreements, subject to approval as to form by the City Attorney, and provided further that in no case shall the city agree to indemnify, defend or hold harmless the State of California, the California Department of Highway Patrol, its offi- cers, agents, employees or any other person from claims or inju- ries arising out of the active or passive fault or negligence of the state, the California Department of Highway Patrol, its offi- cers, agents and/or employees. WITNESSETH, by and in consideration of the covenants and conditions herein contained, the CHP and the City P.D. do hereby agree as follows: 1 . CHP agrees to allow City P.D. to attend training classes during the following period(s) : Motorcycle Enforcement Training Program 10/29/84 - 11/8/84 2 Trainees 2. CHP agrees to provide living, dining, and classroom facilities as required. 3. In consideration for the use of the Academy facilities, City P.D. agrees to pay CHP upon receipt of an invoice in accordance with the following rates: Per resident trainee . . . . . . . . . . .$ 23.50 per day Per nonresident trainee . . . . . . . . .$ per day Instruction fee per trainee . . . . . . .$ 97.70 per 8 hour day Cost per trainee . . . . . . . . . . . . .$ 1,235.50 WrAL AGPM4ENT NOT TO EXCEED $ 2,4 71.00 071-77 (Rev 1/83) 4. The rates indicated in this agreement are for estimate purposes only. Ln the event CHP is granted a rate increase, City P.D. agrees to pay increased rates. 5. City P.D. agrees to indemnify, defend, and save harmless the State of California, the Cam, its officers, agents, and employees, from any and all claims and losses accruing or resulting to any person, firm, or corporation, who may be injured or damaged by the negligence of City P.D. 4' t� in the performance of this agreement. 6. City P.D. shall be resronsible for paying any cost incurred by C:-T for facility damage caused by the willful or malicious misconduct of City P.D. trainees. 7. This agreement shall become effective when signed by both parties, and upon CHP's receipt of a resolution covering the agreement. Training shall not be authorized until the resolution is on file with CHP. 11 8. This agreement may be amended by mutual consent of the parties hereto. 9.
