HomeMy WebLinkAboutCity Council - 5504 RESOLUTION NO. 5504 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF EASEMENTS FOR STORM DRAIN PURPOSES, SHOWN ON PARCEL MAP NO. 79-5851 GENERALLY LOCATED NORTHEAST OF THE INTERSECTION OF CENTER AVENUE AND HUNTINGTON VILLAGE WAY WHEREAS, on February 19, 1985 the City Council of the City of Huntington Beach duly adopted Resolution No. 5497 declaring its intention to vacate easements for storm drain purposes, located northeast of the intersection of Center Avenue and Huntington Village Way, and referring to maps or plans on file in the office of the City Clerk for particulars as to the pro- posed vacation; and Said resolution fixed the time and place of March 18, 1985 at the hour of 7 :30 p.m. , or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for nearing all persons interested in or objecting to the pro- posed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of the proposed vacation were posted conspicuously along those easements shown on Parcel Map No. 79-585, and generally located northeast of the intersection of i:enter Avenue and Huntington Village Way, and such notices were posted not more than three hundred (300 ) feet apart and at least three (3 ) were posted.- On March 18, 1985 at the hour of 7 :30 p.m. , in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all 1. persons interested in or objecting to the proposed vacation of storm drain easements, at which time no objection was made to said vacation, and evidence was presented showing that such storm drain easements are not necessary for present or prospec- tive public use and are not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 3 of the California Streets and Highways Code, commencing with sec- tion 83201, does resolve that the storm drain easements, shown on Parcel Map No. 79-585, generally located northeast of the intersection of Center Avenue and Huntington Village Way, are not necessary for present or prospective public use, and are not suitable for use or development as bicycle paths or routes,. and it is hereby ORDERED that the storm drain easements shown on parcel Map No. 79-585 are hereby vacated; and said easements so vacated are more particularly described as follows: That certain easement for storm drain pur- poses, 20.00 feet wide, as granted to the City of Huntington Beach per Deed, recorded November 101, 1980 in Book 138281. page 192 of Official Records, together with those cer- tain storm drain easements, 20.00 feet wide, as dedicated to and accepted by the City of Huntington Beach on the map of Parcel Map No. pages 31 through 33 , inclusive, of Parcel Maps in the office of the County Recorder of Orange County, California. EXCEPTING THEREFROM that certain portion of the above described easements which will remain in effect, being a strip of land, 20.00 feet wide, lying within Parcel 1 of 2. said Parcel Map No. 79-5851- together with that certain portion lying within the south- easterly 50.00 feet of Lot 5 as shown and described in that certain lot line adjust- ment, LL 83-3, recorded February 14, 1984 as Instrument No. 84-064130 of Official Records in said office of the ;ounty Recorder 79-5851 filed in Book 144, PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 18th. day of March , 1985. Map No. 79-585 are hereby vacated; and said easements so vacated are more particularly described as follows: That certain easement for storm drain pur- poses, 20. 00 feet wide, as granted to the City of Huntington Beach per Deed, recorded November 1041 1980 in Book 13828, page 192 of Official Records , together with those cer- tain storm drain easements, 20. 00 feet wide, as dedicated to and accepted by the City of Huntington Beach on the map of Parcel Map No. pages 31 through 33 , inclusive, of Parcel Maps in the office of the County Recorder of Orange County, California.
