HomeMy WebLinkAboutCity Council - 5520 RESOLUTION NO. 5520 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OPPOSING THE INCLUSION OF PUBLIC EMPLOYEES UNDER THE PROVISIONS OF THE FAIR LABOR STANDARDS ACT (FLSA) WHEREAS, the City of Huntington Beach has negotiated current working conditions, including hours of work, with associations representing police officers, firefighters and other municipal employees; and Work and compensation schedules were matters of good faith negotiation, pursuant to state statutes, between the city and employee associations; and The inclusion of public employees under the Fair Labor Standards Act will require compensation for such employees over and above that currently established through negotiations; and The cost of public service is borne by the resident/taxpayer of the city of Huntington Beach; and Elected city officials have better knowledge of the services traditionally rendered by the city, are better able to gauge the changing needs of the community, and are more responsive to the local residents than anyone could be in the immense Federal bureaucracy; and The cost of placing city employees under the provisions of the Fair Labor Standards Act will make it necessary for the city to reduce services and increase costs to the taxpayer in order to balance its budget , as required by law; and Such new and additional costs come at a time when Federal revenue sharing and other Federal grants have been or are being eliminated or significantly reduced; and 1. Since the passage of Proposition 13 by the State of California, the authority of a municipality to raise its tax base to meet the demands of inflation and the consumer price index has been greatly curtailed, and it is doubtful that cities will be able to fulfill the mandates of the Fair Labor Standards Act for employees without sacrificing or severely reducing important public service programs, NOW, THEREFORE; BE IT RESOLVED by the City Council of the City of Huntington Beach that the United States Congress is urged to sponsor legislation removing public entities and their employees from coverage under the Fair Labor Standards Act .- BE IT FURTHER RESOLVED that the City Clerk is hereby directed to forward copies of this resolution to appropriate members of the Congress .
