A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH DECLARING THAT THE PUBLIC
INTEREST AND NECESSITY REQUIRES THE DISPOSITION
OF CERTAIN SURPLUS PROPERTY, GENERALLY LOCATED
IN THE VICINITY OF WARNER AVENUE AND MAGNOLIA
STREET
WHEREAS, the City of Huntington Beach is the owner of two
parcels of real property, generally located in the vicinity of
Warner Avenue and Magnolia Street, more particularly described
as:
PARCEL A:
In the city of Huntington Beach, County of
Orange, State of California, and being a
portion of the southeast quarter of Section
24, Township 5 South, Range 11 West, as said
section is shown on the map of Tract No.
6626, recorded in Book 249 of Miscellaneous
Maps at pages 9 and 10 in the office of the
County Recorder of said county, said portion
being more particularly described as follows:
Commencing at the intersection of the
centerlines of Magnolia Street and Warner
Avenue, as said intersection is shown on the
map of said Tract No. 6626; thence along the
centerline of Warner Avenue, north 89°32 ' 38"
west 659.81 feet to the southeast corner of
the west half of the southeast quarter of the
southeast quarter of said Section 24; thence
leaving said centerline and along the east
line of said west half, north 00018' 38" east
56.00 feet to a point on the northerly
right-of-way line of Warner Avenue, said
point being also the true point of beginning
of this description; thence along said
right-of-way line, north 89°32 ' 38" west 32.60
feet; thence leaving said right-of-way line
and parallel with the east line of said west
half , north 00°18' 38" east 105.60 feet to a

point on a nontangent curve, concave north-
westerly and having a radius of 226.00 feet,
a radial line to said point bears south
57°03 '09" east, said curve being concentric
with and 26.00 feet southeasterly from that
certain curve cited as being concave north-
westerly, having a radius of 200. 00 feet, a
central angle of 90°09 ' 08" and a length of
314.69 feet in the deed to the Orange County
Flood Control District, recorded February 141,
1963 in Book 6431 at page 936 of Official
4 Records of said county; thence northeasterly
along said curve, through a central angle of
8°55 ' 14" , an arc distance of 35.19 feet;
thence leaving said curve, south 89°41 '46"
east 16.00 feet to a point on the east line
of said west half; thence along said east
line, south 00°18 '38" west 136. 67 feet to the
point of beginning.
Containing approximately 4180.6 square feet.
PARCEL B:
In the city of Huntington Beach, County of
Orange, State of California, and being a por-
tion of the southeast quarter of Section 241,
Township 5 South, Range 11 West, as said sec-
tion is shown on the map of Tract No. 6626,
recorded in Book 249 of Miscellaneous Maps at
Pages 9 and 10 in the office of the County
Recorder of said county, said portion being
more particularly described as follows:
Commencing at the southeast corner of said
Section 241 said corner being the inter-
section of the centerlines of Magnolia Street
and Warner Avenue, as said intersection is
shown on the map of said Tract No. 6626;
thence along the east line of said Section 24
and the centerline of said Magnolia Street,
north 00°18' 50" east 516. 50 feet; thence
leaving said east line and said centerline,
north 89°32 '38" west 50. 00 feet to a point on
a line that is parallel with and 50.00 feet
westerly of said centerline of Magnolia
Street, said point being also the true point
of beginning of this description; thence con-
tinuing north 89°32 ' 38" west 11.41 feet to a
point on the westerly right-of-way line of

said Magnolia Street; thence along said
westerly line, north 02°41 ' 59" west 246.86
feet; thence leaving said westerly line,
south 89°32 '38" east 24. 39 feet to a point on
the abovementioned parallel line; thence
along said parallel line, south 00°18 ' 50"
west 246.49 feet to the point of beginning.-
Containing approximately 4, 412 square feet.-
EXCEPTING THEREFROM all oil, gas and other
hydrocarbon substances and minerals lying
below a depth of 500 feet from the surface of
said land, but without the right of surface
entry at any time upon said land or within
the top 500 feet thereof, for the purpose of
exploting for, developing, producing,
removing and marketing said substances.

The City Administrator has recommended to this Council that
such real property be declared surplus; and
Huntington Beach Municipal Code section 3.06.010(b) author-
izes the city to dispose of surplus property, and sets out pro-
cedures therefor,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does find, determine and resolve as follows:
SECTION 1. That the real property described hereinabove is
surplus, that neither parcel constitutes a buildable site, and
that the public interest and necessity requires the disposition
thereof.
SECTION 2. That the real property, described as Parcel A,-
was acquired by grant deed from Orange County Flood Control
District, dated April 14, 1981, and the real property, described
as Parcel B, was acquired from the California Division of
Highways by Relinquishment No. 555, dated June 21, 1967.
SECTION 3. That the fair market value of the real property
sought to be disposed of has been determined to be $56, 000.
SECTION 4. That the real property herein declared surplus
shall be sold for cash.

SECTION 5. The City Administrator is hereby authorized and
directed to execute all documents and take all steps necessary
to dispose of such surplus real property, pursuant to the deter-
minations of this Council and the procedures set forth in
Huntington Beach Municipal Code Chapter 3.06.
