HomeMy WebLinkAboutCity Council - 5573 RESOLUTION NO. 5573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING DESTRUCTION OF RECORDS IN THE OFFICE OF HOUSING & REDEVELOPMENT WHEREAS, Government Code §34090, et seq. , provides that certain public records may be destroyed with the consent of the City Attorney and concurrence of the City Council ; and The office of Housing and Redevelopment desires to reduce the files kept for the Community Development Block Grant Program; and Such files do not: (a) Contain information affecting the title to real property or liens thereon. (b) Constitute court records. (c) Require retention under any statute. (d) Contain information less than two years old. (e) Constitute minutes, ordinances or resolutions of the City Council or any city board or commission. FURTHER, Federal regulations 24 CFR 58.11, §570. 510, provide that certain federal public records may be destroyed with the consent of the city council and the above referenced files are not: (a) Records that are the subject of audit findings. (b) Records for non-expendable property. (c) Records for any displaced persons. (d) Records pertaining to real property acquisition. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that the office of Housing and Redevelopment is authorized to destroy the above-referenced files presently in the City Clerk ' s vault for the period from 1974 through 1978. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 16th day of September 1985.
