HomeMy WebLinkAboutCity Council - 5665 RESOLUTION NO. 5665 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RECOMMENDING THAT THE ENVIRONMENTAL PROTECTION AGENCY BE RESPONSIBLE FOR THE MITIGATION OF AIR EMISSIONS FROM OFFSHORE OIL DEVELOPMENT WHEREAS, the City of Huntington Beach is located within the jurisdiction of the South Coast Air Quality Management District; and The South Coast Air Quality Management District also includes the counties of Riverside, Orange, Los Angeles, and the urban portion of San Bernardino County, and has more than 11 million residents; and The District is the sole and exclusive local agency within the South Coast Air Basin with the responsibiity for comprehensive air pollution control; and The Clean Air Act and the California State Health and Safety Code mandate the South Coast Air Quality Management District to achieve and maintain the federal and state ambient air quality standards at the earliest possible date by application of the best available technological and administrative practices; and The South Coast Air Quality Management District is a federally designated nonattainment area for four of the major air contaminants and for two secondary contaminants; and It is in the public interest that those standards for the pro- tection of public health not be exceeded; and There are offshore areas proposed for oil exploration and development which are adjacent to the South Coast District and have a potential for significant adverse air quality impacts; and The Environmental Protection Agency is the federal agency most aware of the severe air quality problems and the need for very stringent emission controls in the South Coast District; and The Environmental Protection Agency is the federal agency responsible under the Clean Air Act for control of emissions from onshore Outer Continental Shelf-related activities, including storage tanks and gas processing facilities; 1. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby affirms its support for the ,air pollution control concepts embodied in the South Coast Air Quality Management District' s Rules and Regulations, including Best Available Control Technology for all offshore oil development operations and the resulting distribution and refining of the petroleum products, and the requirement that all net increases in air contaminant emissions must be offset; and BE IT FURTHER RESOLVED that federal regulations governing off- shore oil exploration and development should be consistent with, and at least as stringent as, South Coast Air Quality Management District Rules and Regulations development under the Clean Air Act; and BE IT FURTHER RESOLVED that the City Council of the City of Huntington Beach requests that the Environmental Protection Agency be assigned the responsibility now held by the Department of Interior for regulating air emissions from all facilities on the Outer Con- tinental Shelf.
