HomeMy WebLinkAboutCity Council - 5695 RESOLUTION NO. 5695 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING THE APPLI- CATION AND ASSURANCES FOR GRANT FUNDS UNDER THE COASTAL CONSERVANCY ACCESS GRANTS PROGRAM FOR THE BLUFFTOP ACCESSWAY WHEREAS, the Legislature has established the State Coastal Conservancy (pursuant to Public Resources Code 31000-31400 ) and authorized it to award grants to local public agencies for the acquisition and development of coastal accessways; and The grants are awarded pursuant to Guidelines established by the Coastal Conservancy for determination of project eligibility for funds; and Said procedures established by the Coastal Conservancy require the applicant to certify by resolution the approval of applications and listed assurances prior to submission of said applications to the State; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby: 1 . Approves the filing of an application for funding under the State Coastal Conservancy' s Access Grants Program; and 2 . Certifies that said agency agrees to the attached list of Assurances; 3 . Certifies that said agency has or will have sufficient funds to operate and maintain the project(s) funded under this program; 1 . 4 . Agrees to provide any funds needed beyond the grant requested to complete the project( s) funded under this program through the allocation of uncommitted funds PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 4th day of August , 1986 . 4j'a �. RANCES The applicant hereby assures and certifies that it will comply with Conservancy regulations, policies, guidelines and requirements as they relate to the acceptance and use of Conservancy funds for this project. Also, the applicant gives assurance and certifies with respect to the grant that: 1. It possesses legal authority to apply for the grant, and to finance and construct the proposed facilities; that, where appropriate, a resolution, motion or similar action has been July adopted or passed as an official act of the applicant's governing body, authorizing the filing of the applicatio-_, including all understandings and assurances contained therein, and directing and authorizing the person identified as the offici.al representative of the applicant to act in connection with the application and to provide such additional information as may be required. 2. It will have sufficient funds available to met its own share of the cost for projects. Sufficient funds will be available when the project is completed to assure the effective operation and maintenance of the facility for the purposes constructed. 3. It holds sufficient title or interest in the property to enable it to undertake lawful development and construction of the project. Except in the case where the Grantee is acquiring an interest in the property as a part of the project development such title documentation shall be reviewed by the Executive Officer of the Conservancy. 4. It will not dispose of or encumber its title or other interests in the site and facilities except as permitted by the Conservancy. S. It will give the Conservancy, through any authorized representative, access to and the right to examine all records, books, papers, or documents related to the grant. 6. It will cause work on the project to be commenced within a reasonable time after receipt of notification from the Conservancy that funds havae been approved and that the project will be carried to completion with reasonable diligence. 7.. It will, where appropriate, comply with the requirements of the State's Braithwaite Act (Chapter 1574, Statutes of 1971 and related statutes), which provides for fair and equitable treatment of displaced persons. a. It will, where appropriate, comply with the requirements of the California Environmental Quality Act. 9. It will comply with all requirements imposed by the Conservancy concerning special provisions of law, and program requirements. l ATTACHMENT A GENERAL STANDARDS Standard #1 : The construction of this stairway will provide a safer way of gaining access to the beach . In addition , its use will minimize the destruction, how occurring, to natural landforms and existing plant life as the general public continues to climb the bluff face at this site. The location of this stairway will have no significant impact on environmentally sensitive habitat , privacy of residences , natural landforms or agriculture. Standard #2 : This accessway will prevent the man-made erosion now occurring along this portion of the bluff face.. Standard #3 : The physical constraints of the site do not permit the construction of a wheelchair ramp; however, the stairway width of fifteen feet will provide adequate access to a major recreational area . Standard #4 • There are no adjoining residences ; therefore the impact of this project relevant to residential neighborhoods is a moot point . Standard #5 : The natural landforms in the area of this proposed stairway are being damaged as a result of people climbing th bluff face to gain access to t:he beach . This accessway will reduce this destruction of natural landforms and plant life . Standard #7 : Definition - This public accessway will provide a vertical connection between the bluff top, directly adjacent to Pacific Coast Highway, and the beach . Specification - The width of this vertical accessway is fifteen feet . Location - There is no accessway to the beach between Seventeenth Street and Goldenwest Street (Twenty-Third ) . The proposed location of this stairway is directly adjacent to Twentieth Street . An accessway at this site will provide direct access to the beach . Urban Areas - At present, there are no residential developments on the ocean side of Pacific Coast Highway; however , housing does exist on the inland side of the highway. Streets Seventeenth through Goldenwest (Twenty-Third ) are -perpendicular to and end at Pacific Coast Highway. Residents on the inland side of the highway can only gain a safe access to the beach at Seventeenth or Goldenwest Streets. The distance between these access points is approximately 1 , 900 feet . An accessway at Pacific Coast Highway and Twentieth Street would split this distance. Rural Areas - not applicable Facilities - This vertical accessway is a concrete structure designed to accommodate heavy foot traffic . Its placement at this location will not adversely impact drainage systems or bluff face erosion . Standard #9 ( Scenic Overlooks ) : Definition - This scenic vista will provide an opportunity for the generai public to set or stand in a designated area and view the beach and ocean . Specifications - This scenic overlook is directly adjacent to the Pacific Coast Highway bike trail . Construction of this vista includes an accessway to the beach , sitting benches , security lighting, a drinking fountain, and a pay telephone . Location - Access to this overlook is easily obtained from Pacific Coast Highway and the beach bike trail . The view from this vista will be unique in that one will be able to view the coast line north and south and Catalina Island. Facilities - This vista will be constructed of interlocking concrete pavers and will include landscaping and 'safety nailing (when applicable ).. P R O J E C T E V A L U A T I O N 1. URGENCY Is this project identified in the Local Coastal Plan or on the B.C.D.C. Public Access Supplement Map? No What are the closest public access points to the north and the south? There are existing accessways north and south of this proposed stairway to the beach. The Goldenwest accessway is 950 feet to the north while the 17th Street accessway is located approximately 950 feet to the south. Describe any ongoing conditions which present public hazards. Beachgoers attempt to climb down the bluff, and may fall. The accessway will provide safe access to the beach. Describe any ongoing degredation of natural resources on the site, and the expected effects of the projec'-- on such. The accessway will prevent erosion to a coastal bluff , due to attempted access at this location. Are there matching funds available for this project? Yes . Orange County has granted ',575 , 000 for this project. will this project reopen an accessway closed by storm damage or deterioration? No. Z. INNOVATION mkm DESIGN ERCE'..Zm;cE Please discuss any innovative aspects of the proposal. Include any unique funding, materials and/or design, innovative management, or cooperation among several groups or agencies. a . Oil company' s use of pipe chase as a landing area . b. Tiered design allows for unobstructed view of ocean while seated on benches . c . Future interpretive display depicting the oil industry' s contribution to development of` the State . d. Future historical location monument indicating geographic and historical features of the area. 3. COST EFFECTIVENESS Please discuss the cost effectiveness of the project. Consider the expected number of site visitors and the life span of the accessway. The expected life span will be 40 years. The expected number of site visitors will be 10 million over the life of the project. The beaches presently receive 9 million visitors a year, and the number -wi 11 increase=__in-bhe_ future_ _ 4. UNAVASLAB LITY OF FUNDING FROM OTHER SOURCES What are the various funding sources for the total project? Please specify whether federal, state, local, or private. Orange County has granted $75, 000 for the project. An application for $11, 733 has been made to the Coastal Commission for Phase V funds. Please note any matching funds or services, inctl c- their -arces. In conjunction with this project, the maintenance of the bluff will include restoration of the vegetation and erosion prevention through construction of a retaining wall. The City will maintain the improvements over the life of the project. Matching funds are also. provided by Orange County as described above, S. INCREASED ACCESS Has the site provided public access at some time in the past? Is the site currently accessible to the public? How will this project increase access? The site is currently accessible to the public if they are willing to scale a bluff . The protect will provide access to less agile beachgoers and will decrease liability risks . 6. CALIFORNIA CONSERVATION CORPS Please indicate the role that the California Conservation Corps is expected to have in construction of the accessway. The City will request their assistance in constructing the improvements . 7. CEQA COM..PLIAN-ZE Please give a preliminary determination of the means by which this proje::t will comply with CE2A requirements. The project is exempt under CEQA. E ' SUPPORT M ATE R I AL S The following materials are required to complete your grant application:- 1. A preliminary cost estimate itemized by labor and materials. (Administration and engineering costs should not exceed 10 percent of the project costs. ) - 2. Conceptual scale drawing of the project indicating property boundaries, project design,, and access sign locations. 3. Location sap indicating existing public access points adjacent to the project site. 4. Schedule indicating key interim dates and project completion. 5. Coastal Projects only: Identification of offers to dedicate (access, open space, etc. ) in the jurisdiction that will be accepted by the applicant (primarily local government applicants only) . 5. An overall sigring program to identify currently open, but unsigned, public accessways. This program should include on-site plus direr ional sig:ing from the nearest State Eighway (see Appendix F). 7.
