HomeMy WebLinkAboutCity Council - 5829 RESOLUTION NO. 5829 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR ATTORNEYS WHO ARE MEMBERS OF THE CITY 'S PERSONNEL SYSTEM TO PERFORM LEGAL SERVICES SOLELY AND EXCLUSIVELY FOR AND ON BEHALF OF THE CITY WHEREAS, the CITY OF HUNTINGTON BEACH employs a staff of professional attorneys who are members of the city 's personnel system and who are under the direction of the elected City Attorney; and The City Council by Charter controls the legal business of the city; and The City Council by Charter is empowered to control the hours of work of the City attorney and by virtue of that power of the deputies and assistants of the city attorney; and It is the sense of the council that its in the best interest of the CITY OF HUNTINGTON BEACH for the City Attorney and the deputies or assistants to perform legal services solely and exclusively for and on behalf of the CITY OF HUNTINGTON BEACH and not otherwise; and The Council finds that the City Attorney and the deputies and assistants are required to be reasonably compensated by the city for full time service to the city. NOW, THEREFORE, the City Council resolves : 1 . The elected City Attorney and the deputies and assistants who are employed by the city on a full time basis and who are members of the city's personnel system shall not engage in the practice of law except for and on behalf of the city and for and on behalf of -1- those persons and agencies the City Attorney is required by law to represent. 2 . The City Attorney may represent and may authorize the deputies and assistants to represent pro bono clients on a non-interference basis consistent with the ethics and practice of the bar . 3 . The City Attorney may represent and may authorize the deputies and assistants to represent themselves in pro per or in pro se . The City Attorney deputies and assistants may also represent their relatives to the third degree of relationship.
